Umm... psychologically it doesn't really matter if you have both hands free... Just being in a heated conversation or emotional conversation PERIOD, even with a bluetooth is just as distracting as having your hand on the phone. (this study has been proven) and was taught in my Cognitive behavior class.

I was talking to a Monterey fire fighter who said their station was given the option of being exempt from the law, but they chose not to be exempt. I'm sure the officers chose to be exempt, even though with all they have to do in the squad car, they really should have as many free hands as possible.
Check out the top news hits (already learned in college a few years ago) Handsfree doesn't reduce accidents. Well NO ****, get with the program America... like 5 years behind the guys making the $$ off these stupid laws.
I do both, if I have my headset on me or if I remember to turn on my blue tooth to pair with my deck, then I'll go hands free, otherwise, I'll hold the phone, turn on speaker phone and just hold it below my window sill if I see a cop near by.

cops are exempt from the hands free phone law. why? because they already operate computers, radios, and numerous other devices whiles driving... because, oh yeah, they are trained to do so...
cops don't get speeding tickets while rushing to an accident, crime scene or whilst in pursuit either despite technically going faster than the speed limit.

and for the record just incase anyone didnt know. speakerphone on yoru phone is not considered hands free. yes it is a good way to trick the cops cuz it is not in your hand on yoru ear but you are still holding the phone and police and chp will give you a ticket for that just as well as txting. hands free means HANDS FREE! MEANING NO HANDS TO TALK ON PHONE.
just a heads up. (iphone users)
) but when i do, it's speakerphone on my lap. http://www.chp.ca.gov/pdf/media/cell_phone_faq.pdf
