Murder in the 2nd degree. I just don't see how that can be. Anyone have the legal language for that?

I will be pissed if he walks away. He should've been charged with something lower than murder. I really don't think he intended to shoot him, but that he failed to not shoot him. I don't see a reason for pulling out the gun and aiming it, but, **** man... Murder is a damn stretch.

yup... i looked it up:

Second-degree murder is ordinarily defined as 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion" or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. Second-degree murder may best be viewed as the middle ground between first-degree murder and voluntary manslaughter.

For example, Dan comes home to find his wife in bed with Victor. At a stoplight the next day, Dan sees Victor riding in the passenger seat of a nearby car. Dan pulls out a gun and fires three shots into the car, missing Victor but killing the driver of the car.

sounds like a very appropriate charge.

I don't hope that he gets off entirely. And if it were a relative of mine, I would be furious. But, you still have to look at it from all angles. What about the police officer's family? His newborn? Voluntary manslaughter maybe, but certainly not murder.

^ Agreed. I was thinking more along the lines of Criminal Negligence..
He pulled the gun and aimed likely to cover the guy incase of possible weapon. The more I hear the more it sounds like he kept reaching in his pocket for his phone. This is just monday morning QBing but maybe cop pulled gun in case the guy on the ground had reached for one and then poor finger placement caused Neg discharge. Still criminal but not murder..
