Murder in the 2nd degree. I just don't see how that can be. Anyone have the legal language for that?
I will be pissed if he walks away. He should've been charged with something lower than murder. I really don't think he intended to shoot him, but that he failed to not shoot him. I don't see a reason for pulling out the gun and aiming it, but, **** man... Murder is a damn stretch.

yup... i looked it up:
Second-degree murder is ordinarily defined as 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion" or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. Second-degree murder may best be viewed as the middle ground between first-degree murder and voluntary manslaughter.
For example, Dan comes home to find his wife in bed with Victor. At a stoplight the next day, Dan sees Victor riding in the passenger seat of a nearby car. Dan pulls out a gun and fires three shots into the car, missing Victor but killing the driver of the car.

Why does everyone hope that he gets the book thrown at him? I hope he gets off, because I truly believe that it was a mistake, and as a police officer, we should give him the benefit of the doubt. Now, if there are ongoing continuous complaints about a particular officer, thats a different story. But still, his life doesn't need to be ruined just to prove a point.

The lawyer is going to pick apart the degree of intent and try to downplay the role of the officer killing Oscar to the officer 'accidently discharging his firearm in Oscar's back'.

You hope he gets off???? wow? Just one quick question....If this was your relative....lets just say a brother of yours, would you still feel this was? Would you atleast want something done for the cop's "Mistake?" I respect what you think in saying it that its all a big mistake...but he is a trained proffesional that WE the public should be able to trust with a Gun...You dont think he should at least be charged for what he did?

Hey there Mr. Basil, I'm sure that you feel you that you've got the best of me. But now I feel that I will have to do a short profile of yourself. For all the forum to read.
I'm guessing that you are in your mid twenties, still live at home with Mom & Dad, and carry $20,000-$30,000 credit card debt that you will never be able to pay back. Typical Liberal.
I entertained the thought of verbally castrating you on the forum here, Just for the fact that when you went to your Group Hug Therapy Session to cry like a little boy, you'd actually be the hit of the meeting. Liberals Anonymous is a meeting I'll never attend.
How much sleep do ***gots like you lose over how do dress Nanci Pelosi?
Sonny...... you stinkin' up the playground....... about time you run on home and have mommy tuck you in.
And as far as you view the protesters...... protesting always lead to riots. Always.
You are a Liberal retard........ You Savvy?
Shame on you sonny.........
Cry me a river about the Newark Riots that I witnessed firsthand. Just a couple protesters they were ........ FU

He pulled the gun and aimed likely to cover the guy incase of possible weapon. The more I hear the more it sounds like he kept reaching in his pocket for his phone. This is just monday morning QBing but maybe cop pulled gun in case the guy on the ground had reached for one and then poor finger placement caused Neg discharge. Still criminal but not murder..
