OAKLAND, Calif. -- Former BART police officer Johannes Mehserle did meet with investigators probing the New Year’s Day fatal shooting of a Hayward man but chose to invoke his Fifth Amendment rights against self incrimination, officials said Monday.

BART general manager Dorothy Dugger and transit police chief Gary Gee told an afternoon news conference that Mehserle was questioned within three hours of the fatal shooting of Oscar Grant III, but quickly asked for an attorney, refusing to cooperate.

The transit agency has been under fire for its handling of the case and among the most emotional complaints was that Mehserle had yet to be questioned. Monday’s announcement was the first public acknowledgement that Mehserle – who has resigned from the BART police force – has been questioned.
so he is automatically guilty because he headed to his Miranda warning?

not saying that he is not, but just because he invoked his "right to remain silent" does not automatically prove guilt.

Another Observation:

Why is the cop is being blamed for this killing?
Every good Socialist knows that people don't kill people...guns kill people.

The officer will probably get manslaughter but nothing has been determined and I will continue to voice my thoughts until he gets whats coming to him. This mans death deserves justice and this cop needs to be checked, charged, and serve his time.

Who the **** are you to call this worthless anyhow? Go learn some **** before posting useless threads and trying to be a smart ***.

you better check your attitude at the door. you dont know who i am or where i stand on this issue.

you dont know my background, you dont know how this affects me personally.

as a matter of fact YOU KNOW NOTHING ABOUT ME.

WHY DONT YOU PROTEST THE 124 MURDERS IN OAKLAND LAST YEAR BECAUSE ALL OF THOSE WERE INNOCENT SLAYINGS??

I witnessed a mother and her unborn child die due to random gunfire in a ghetto. WHY DONT YOU GO PROTEST THAT>>!>??!? Sure was an innocent life taken there... she wasnt armed, she didnt resist anybody. she was standing on a street corner when a car rolled by and shot her.

The BART officer has reports from 3 different agencies. DA is trying to file charges. WE ALL KNOW HE WILL GET MANSLAUGHTER> THERE IS NO NEED TO GO ON THE STREET AND PROTEST.

And im not trying to be a smartass, calling it as i see it, and i do know my ****.

They arrested the officer..

OAKLAND — Johannes Mehserle, the former BART police officer who shot and killed an unarmed man New Year's Day, was arrested in Nevada Tuesday night on a murder charge by the Douglas County Sherriff's Office, the Oakland Tribune has learned.
The arrest was also confirmed by David Chai, the chief of staff for Mayor Ron Dellums.
Mehserle's killing of Oscar Grant III has led to massive public outcry, particularly since video of the shooting surfaced. Reached by phone Tuesday night, Grant's step-cousin Joaquin Lascano said he hoped with Mehserle's arrest "justice will be served and that this will lead to a quick and speedy trial.
"Because I feel there has been enough waiting when it comes to the process of this case."
Lascano said he's pleased Mehserle has been apprehended so "we can finally start moving with the proper process." He declined to comment on last week's mayhem in downtown Oakland where a small band broke off from a peaceful protest to cause mayhem, igniting Dumpsters, cars and smashing windows.
As many as 105 people were arrested and no less than $200,000 in damages were inflicted on Oakland businesses.
The arrest came as more than 1,000 people are expected to march and perform a "die in" this afternoon at a downtown protest against the BART police killing of Oscar Grant III, organizers said.
Leaders with the Coalition Against Police Executions (CAPE), the central organization behind thedemonstration, said the mayhem that followed their protest at the Fruitvale BART station was a spontaneous gesture that didn't represent their goals.
Those who join the protest today are asked to wear white to represent the peaceful spirit of the event, organizer Dereca Blackmon said.
The rally will begin with speakers at Frank H. Ogawa Plaza at 4 p.m., followed by a march to Alameda County District Attorney Tom Orloff's office.
Organizers have demanded Orloff file second-degree murder charges against former BART police Officer Johannes Mehserle, in response to witness cell phone videos leaked to the media that appear to depict Mehserle shooting an unarmed Grant, of Hayward, as he lay facedown and restrained at the Fruitvale station after officers responded early New Year's Day to reports of a fight on Grant's train.

wow, maybe if we wait a bit longer, there will be a trial and possibly a conviction.

if a black man in oakland shot a white cop would there be an immediate outcry for a fast arrest and conviction?

And the same goes to you, you dont me. You are trying call me out and asking me to name 5 people who were killed by officers in a similar fashion. Oh BTW I did name five......

And to me it more than just this one incident, it the whole ****ty situations that have been going on for decades. Regardless of the officers outcome the community has every right to meet, discuss, and rally/protest these wrongful deaths, stupid situations, and overall express ones feelings on these items. To me its a form for such discussions that will lead to other community groups and so forth.

As far as you witnessing a death, that I am sorry for and I know how that feels/is. There are several deaths that happen and people simply do not know about them because they do not gain the media/press. Thats the honest truth and it sucks.

This is why I like you; you're an idealist like me when it comes to social measures.

However, you and I will be waiting for many, many, many years.

I agree, but The System appears to be working in this case.

I have absolutly no problem with the community outreaching and speaking their mind.

I DO have a problem with that outcry turning into Rodney King Riots. Its complete bull ****.

I know 90% of the people dont mean any harm. Unfortunaly any time you get a large group of people together, thats what is going to happen.

There was a bart meeting which invited the public to speak their mind, All was civil because the morons who screw everything up did not know about it.

there is no point in flooding the streets.

OPD has literally shutdown the police building for 14JAN09 (wed) and put all investigators, admin personel, and anybody else who is sworn, On the streets, In riot gear.

Now tell me why OPD even needs to do that. The investigators could be inside solving crimes. Why are they on the street waiting for rioters to start vandalizing.

Like i said, I have no problem with you folks speaking your mind, But there is a better setting than clogging the streets, and attracting the crowd that wants to destroy things. (half the rioters think OPD shot the guy )

and as far as witnessing murders / deaths. Ive probably seen 25 in the last year. Thats the only one thats stuck with me.

I dont usually get choked up but watching the doctors try and deliver a 7 month old baby from a dead mother only to perform CPR on the child and have it die in front of you.....not cool.

So protest violence in oakland in general. Take your community back, dont create more animosity towards the already understaffed police departments.

the guy made a mistake, hes going to jail. end story

For some people yes, but not everyone. I mean there will always be a few out there just to stir up the drama. There are still far more who really want to glue their community together and get some sort of unity going.
