What should I do? (car damaged by uninsured motorist)

Turn it in to he DMV!!! He will be screwed on his insurance rates for the next 3 to five years.

It sounds like small claims court is your only real option. As others have said, you will get in trouble too for not reporting the accident.

It sucks that when you try to be nice, you get screwed, and then stupid people call you names for trying to be a compassionate person but the sad truth is it just doesn't pay to be nice. I have a few friends who have dealt with similar things and the person who wants you to be nice is really just asking you to be stupid. I consider my insurance part of driving my car, and I look at it that way for other people too.

I would not go to the police until you are sure you can do so without also being at fault. If you have a signed contract between you, that is enough for small claims court.

i did this once a few years ago. i immediately got 3 quotes, had the guy pay me for the average of the 3 (they were within a few bucks). my only condition was that i had to have a cashiers check on day 8 of the 10 day window or i was going to report the accident. thankfully everything worked out.

i guess what you need to think about is how much are they willing to pay for the exhaust damage? would that reduced ammount offset what it would have cost you in insurance deductible and increased rates? would your insurance company have replaced aftermarket with aftermarket?
