What should I do? (car damaged by uninsured motorist)

What should I do?

Ok this is a long story but please bear with me. On december I got hit by an uninsured motorist, It was near christmas and he was begging me not to call the cops. So in the end I didnt since it was near christmas and i felt kind of sorry for him. I drafted a contract which pretty much states that he is liable for all the damages and i also got all his information down. He agreed to pay me every 2 week until he pays off his debt.

The damages came up to be app. 3400 dollars, 2230 for the body work, 350 for the rear lip and 750 for the exhaust system. He has already paid me 1200, however he said that he wont pay for my exhaust because he said quotes, " an exhaust system cant cost that much." His friends was also there and he said that there is no way the entire catback is damage, if anything its just the muffler. I showed him the catback two weeks ago, but he just looked at it and walked away. Now I have to show his friend the exhaust again to prove that the entire thing is damaged, it was leaking in three different places.

I also gave him copies of all the invoices for the stuff I bought which includes the rear lip, the exhaust and the estimate from the body shop. Today when i went to collect funds from him we had a huge argument. Pretty much he didnt want to sign one of the contract that i drafted which states the parts and amount. He said that he can find the exhaust for cheaper, and i said to him thats how much i paid for it so i want that amount back.

What should I do now, any advice suggestion?

Give him 2 options. Pay or talk to the popo. What exhaust was it?? Sorry to hear that this is happening to you. If he does get to the point to where he does not want to pay for that or anything else, and you do resort to calling the popo's. He will more then likely lose his license for 6 months to a year. My friend was pulling out of his driveway, had no inurance at the time when some lady hit him on the side. Everyone tha saw it basically blamed him, okay he works for a body shop, and offered to fix her car w/o invloving the popo's. After everything was done and said the ladies husband turned him in, because he didn't like the overall look of the newly painted parts to the OEM parts. He lost his license for a year, and had to pay mad fines too. Hope this SOB pays for your car to be fixxed, and gets waht he deserves. Peace.

you'll almost always get screwed over trying to be the "nice guy" I gave up years ago with situations like this.

Probably going to be hard to involve the police at this late date.
I'd call and talk to the local police and see what they advise. Also, maybe see if there is a lawyer that is willing to look over the situation.

Looks like you made a big mistake. I don't even let my coworkers or freinds slide without insurance involvement. Sounds like it was your fault for letting that happen in 1st place. You are not living in a nice utopia. Real world is filled with people who would take advantage of you. Face the fact, you are getting screwed by this person. He/she thinks you are .... Does this make you a little angry? It should. Get your insurance agents and authorities involved!

Yeah, things like this always happens. You try to be nice and later on you get screwed. Do what people suggested, tell him to pay or go to the cops. This could proabbly end up in court too, sounds like one of those small claim court cases.

If he drafted it and the guy signed it, then I think the cops should still be involved.

since you have already made an agreement with him and collected partial payment, youre screwed. lol insurance companies wont help. you should have handed his *** your claim number instead. take his *** to small claims court. warn him and if he doesnt pay up, then do it. its your only choice after that.

how do i know? i used to work for an insurance company. =)

I'd say small claims might still be your best bet.

going to the police at this time is a bad idea- you are just as guilty as he is of not reporting the accident, so I'd advise against it

When people owe me money I give them 2 options. I tell them I can take the money out of their pocket or I can take the rest out on their head. People usually don't owe me money. Its cool that the uninsured actually has payed you at least some of the cost. Consider yourself lucky!!! SO many of my friends have had their cars busted up by youngbloods with the standard oakland dreadlocks who disappear into the night runnin. My advice would be to tell that mutherF!@%*r that what he damaged hes gna pay for and that he's lucky he's not in jail!!!!!If he doesnt pay up then give him the 2 options and beleive me-you doing him too gracious a favor!
