It depends on which tools you use actually. Conceptually, its all the same thing... software that lets you edit ROM files and flash and log the ECU.
I don't believe that the popular open source tools (EcuFlash and RomRaider) were ripped off from Ecutek at all. They have a very different code base, as well as a different look and feel. EcuEdit, however, appears to be reverse engineered from Ecutek software. It looks damn near identical
.
That being said, Ecutek is a horrible, greedy company and I predicted their downfall back when the first AccessPorts started coming out.
FWIW, I had a similar experience with them to Mike and Paul. I purchased the software for upwards of $5k back in 03-04. My dongle was stolen along with my laptop out of a car and after calling Ecutek to replace it, I was informed that I would have to pay the entire price of the software package again ($5k+). That was the end of my relationship with that company.

Ed has his lovers and haters, but one thing is for damn sure he is gonna do the best possible job for a tune for what he's dealing with. He does not mess around when it comes to tuning Subaru's and what his whole business is based off of. Sometimes its hard to make him happy enough to tune, lol, but its really in your best interest.
So +1 to seeing Ed.

I had actually written up a pretty large reply that included a lengthy discussion about what all is involved in ecu reverse engineering and mapping.. And an analogy that saying EcuTek was ripped off is about like one aftermarket part company claiming another ripped them off because they made a similiar part - as they are both patterned after the original.. But eventually I just deleted it and said "wrong" as I didn't really feel like fanning any opensource hate...

<soapbox>
And the term "Opensource" is not limited to a bunch of pimple faced kids that want to twiddle their ***** for cheap because that is all they can afford.. Opensource is more of an ideology than anything.. Software who's source code is free for the taking by anyone / turns development into a community effort.. In the opensource tuning world there is a lot of very hard work being put in by people like me - who work in the IT industry, but volunteer some of their free time to develop a free product.. I used to contribute a while back - but it's a completely thankless task.. A LOT of hard work goes into it.. Any monkey can hire a buncha developers to write some snazzy program to package for sale for profit.. - I have a lotta respect for the guys that do it for free...
