I called up the dealer today expecting to get some word on what Subaru had to say about my car/warranty (was told they would know today). I was informed that the only person who knew about what Subaru said would not be in today and thus I would have to wait until tomorrow at the earliest to find out.

Didn't update this yesterday. I called up Capitol in the morning to ask if there had been any update from Subaru regarding my car. They said that they had not heard anything back yet.
About 20 minutes later, Subaru of America called me and asked if my car was actually at the dealer. I told them that it had been there since the 5th. The lady told me that she had been told by the dealer that they didn't even have the car at their shop. I told her it should be there and that I would give them a call to figure out what was going on.
I called the dealer back and my service adviser was surprised and said that he would give SoA a call and see what is up. I called back later in the day and was told that nothing further had come from Subaru about my car.
Ugh...

We went to the dealer Friday and had a nice long discussion with the Service Manager. The Conversation was both very informative and very disturbing. I learned that my engine would need to be replaced and that there was even a Subaru Technical Service Bulletin for the exact problem my engine had! I was shown that attempts were being made to contact Subaru about the warranty.
The disturbing part was that I learned that the "Modification Report" was put in on my Vehicle AFTER (???) I bought it... Apparently due to a previous incident with Subaru, modification reports are now completely anonymous and can be put in by any dealer simply by calling Subaru. The best part is, there is absolutely no information in it about what was modified and/or when it was modified! Genius!
My car has been to two other dealers, Carlsen Subaru to have the brake pads replaced (under warranty) and Stevens Creek Subaru for a bad MAF sensor connection (read about experience here: https://www.i-club.com/forums/bay-area-15/issues-between-capitol-stevens-creek-subaru-220399/). The only modifications on the Vehicles when they went to the dealers were: Catback exhaust, K&N drop-in air filter, and Kartboy Short Shifter. Why any of these would warrant a "Modification Report" (that could potentially deny warranty on a engine) on my car is beyond me.
That being said, I was told that I would get a call on Tuesday to update me on the status.

Been a while, but finally today they got back to me saying that they will replace the engine if I buy a new Subaru ECM from them at $442. Not really sure I am up to paying $442 just to get my car fixed under warranty, but it may come to that.

That's bs that they didn't disclose that information to you. Previous owner seems like a tool that didn't know what/how to mod a Subaru. I'd probably sue them, but I'm glad you're getting it replaced. Good luck!
Now, you mentioned a Tech Service Bulletin for your engine. Can you provide specifics? Is this for the ECU reflash/stop sale back in 2008 or something else? I ask because there have been a lot of 2008/09 STi's with cracked ringlands causing engines to go. So far, there has been no formal admission of a problem from SOA.
