It's too bad you have to wait so long to get your transmission rebuilt but good to hear that the first shop won't be charging you for the work they did. That's about the best you could hope for at this point. Sometimes people take businesses to small claims court but in a situation like this the judge almost always rules that the business refund any money you paid them for their services but we aren't entitled to anything like 'pain and suffering' like an accident victim in a civil law suit. At least the shop volunteered to eat the cost of their time so you didn't have to fight for it.
