I've used a bluetooth headset in the car since it got converted to a manual, but after more than like 10 or 15 minutes it'd bother my ear. I don't know how some people walk around all day with those things!

sooooo.........per CA DMV VC section 23234, paragraph (a)

(a) A person shall not drive a motor vehicle while using a wireless telephone unless that telephone is specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving.
so yes, you can use a phone with a speaker phone (just to clarify).

and paragraph (c)

(c) This section does not apply to a person using a wireless telephone for emergency purposes, including, but not limited to, an emergency call to a law enforcement agency, health care provider, fire department, or other emergency services agency or entity.

your honor, I was talking to my Dr., I was concerned about some XXXX symptom I was suddenly having, and wanted to make an appointment or see if I should go to the emergency room.



OH...and just for discussion sake....sections (e) and (f) are interesting...its basically saying if you're working in one of the following vehicle's, its OK for you to use your Nextel 'push to talk radio feature'.

what a load of f'ing crock this law is. no talking on the phone should mean no talking on the phone...."oh, but if you're a delivery truck guy, or a freaking SCHOOL BUS DRIVER....its ok to talk and drive.'

^ if they really want to get into it im sure they could get your phone records and see if you really called the doc

oh ya another thing thats kinda dumb about the "hands free" law

so you cant drive and talk while holding your phone, but can txt..

so how about all the people that:

read the newspaper, put make-up on, hold a drink, idk what else?

they could....well, the COP would have to do that. He'd have to be smart enough to subpoena those records before hand.



either way, for the chick that just got the ticket, I wonder if the cop just gave her the ticket, or if he at least asked who she was talking to?

the other thing I found interesting.....she just got pulled over JUST for that? From this Harvard BLOG:
