so if the gun is your hand you must have pulled the trigger? I know, dumb analogy but that's the basic point.....I can make up 100 reasons why I just 'happened' to pick up my phone while a cop randomly drives by and looks at me.

burden of proof is on the cop. too many times people just pay tickets and assume you can't get out of it. Reasonable doubt isn't too hard to establish on something like this....you just have to have the ***** to go to court and argue with a cop. In this case, totally not worth your time for a $20 ticket or whatever.

holding a phone to your ear has become a comfort blanket to some people, like a teddy bear lol. It does keep your ear warm, and promotes brain tumors.

I washed my headset. Needless to say it doesn't work anmymore. Yesterday - bought one that clips on the visor. Speaker phone style. It's a moto. Works really well. Noise cancel, loud and clear. Best part it stays in the car, I don't have to worry about it sticking to my head or leaving it in my pocket.

Yup. I saw the same thing on the news last night. ALl the cop has to do is see someone with a phone to their head, and they get a ticket. No contest.
Can we get some stats on this?

I heard there was a study done by the LA Times that found that people using Bluetooth ear pieces drive just as bad as when they have the phone to their ear. So we'll just have to wait a couple months and see if there is a difference on the freeways with accidents and crap.
So you just happen to pick up your phone cause it's sliding around and you put it up to your ear after you pick it up just because you feel like it? You having the phone to your ear is my argument. Why in hell would any person have a cell phone, up to their EAR if they weren't talking on it. Having it in your hand is something different and wasn't my point.
You can get out of speeding tickets when you are CAUGHT going 80 in a 65 on radar....if you request to see the officer's training record (they're required to have 24hrs of training on the device) and the officer doesn't have it, you can request the charges be thrown out due to lack of evidence because the device was potentially not properly used.
My point is enforceability....cops can give you tickets for whatever.....you can also get out of any ticket too, if you know your rights and don't mind going to court and finding a way out of it.
I find this 'law' to be pretty easy to get out of if you really want to put in the effort.
so yeah...phone up to your ear? sure, you probably are using it....and the cop will probably give you a ticket.....but I bet at least 50% of the time you could pretty easily go to court and ask a few key questions to the cop and put in enough reasonable doubt to the judge to have him dismiss it.
but for a $20 ticket, what's the point...

Have a plantronics voyager. Works fairly well, buttons are a little hard to handle, but works 100000000 times better than any motorolla bluetooth. I think I have some extra Plantronic voyagers lying around my house, but I have to look first. I'll post an update
What people need to keep in mind is, like so many other laws, this one is more of an optional check box for a cop. Like, now they can use it as a reason for having pulled someone over but it most likely won't be the SOLE reason each time or even for the majority of them. Seems like it will be linked such as "you were weaving all over the place and your left tire crossed the solid line (crime) and you were on the phone (drives the point home since at this point, this crime is the reason for the previous ones).
I still have no idea why people sport around with a bluetooth thing in their ear all the time. It seems like some older people think of it like a fashion statement or something. It seriously makes people look retarded. I have one, and I use it every once in a while but take it off ASAP. Haha..
Personally though, I have always HATED being on the phone whilst driving regardless of a headset or not. It's stupid and SO distracting. Texting is even worse since your vision is pulled away as well. I usually commute on my bike tho so being on the phone isn't even an option. My other cars are mostly too loud to carry on a conversation. Currently daily driving a '72 Z28 with a 383 and turndowns so you really need to shout to speak to the passenger. Keeps it safer.

Haha.. Working on it, sold the R32. I actually am talking to a buddy about potentially trading the 327 powered 240Z for a bugeye sedan. I am told that would be stupid, but who knows.
