It's been said before, but these laws are complete bull****. It is already against the law to do ANYTHING that distracts you from driving your car.

Oh, and $20 for your first offense, $50 for your second?!?!??!?!?! BIG ****ING DEAL. It should be a ****ing 3-strikes rule to suspension. Un****ing believable.

Yes they can. No matter how you delete if off the phone there is still records of the text and time.

After giving this some more attention and driving a few more miles this morning, I still see people yapping away on the phones. I guess I should be worried about glancing at my screen anymore.

well ya if they really want to get into it.. but if you crash and delete said call log or messages and dont act all "omg i hope they dont find out i was talking/txting" they prolly will not go to that extent to find out, i would think

Doesn't the cost end up being more than $20 by the time all is said and done? I heard it's similar to the final number for a Hands-free phone violation ticket, which can be around $100.

But either way, it's definitely not enough and should be raised considerably.

CHP pull their weight? They do their jobs. Their jobs are to write tickets. That's it. That and clean up accidents. They do that. In my opinion we're spending too much money as a state on CHP and not enough on true law enforcement. $80,000 for a CHP officer and $27,000 for a teacher. WTF?

And do you realize how much it cost TO pass that law. How much the douche bag law maker was making. All the other costs involved. They're gonna have to write tickets for a few years before the cost/revenue benefits even come close to showing up. $100 for 10 minutes? Oh you mean it only took the officer 10 minutes to write the ticket, the paper processors to process the paperwork, the clerk to be at the court, the judge to show up, the paperwork, etc etc etc.

And the percentage of unlicensed or say uninsured that are gonna get caught BECAUSE of this law is so low that its not even worth including in the value of the law.

This state has full time lawmakers and they make up stupid **** like this to keep their overpaying jobs.

NO FULL TIME LAWMAKERS PLEASE.

I'm trying to find that out for you. But what I can tell you is that california lawmakers make ridiculous money. Take this for example... the state budget was 2 months late. They get their money withheld until they finish the budget... but... when they get it they get it in full plus interest. And all the while when they're in sac working they get $1000 a week in per diem. So they're getting their full pay, plus interest plus $1000 a week to be late doing their job. A normal year per diem totals are around $35,000. On top of regular pay... oh and that's all tax free. They're the highest paid in the country at somewhere in the neighborhood of $115,000 a year plus the $35,000 in per diem, plus cars, gas and other expenditure accounts.

I just read a few articles talking about CHP ramping up forces specifically to target cell phone users... that's an expense right there. More officers on duty and likely more on OVERTIME. And more hires.

I also read that there's no difference between talking on your phone with your hand to using a hands free device and both are quoted in a couple studies as being as likely to cause an accident as driving drunk.

Sounds terrible but when you think of how many more people drive on their phones to how many drive drunk its not as bad as it sounds. I'm sure it causes about as many accidents per year as people doing say.. their make up, reading, drinking a cup of coffee, etc. Pretty soon its gonna be illegal to drink coffee in the car because you might burn yourself and cause an accident.

did you read the article where did you get this information cuz its says in the article


The bill was written by State Sen. Joe Simitian, who also authored the cellphone ban. First offense is $76. Schwarzenegger's comment, via press release: "Banning electronic text messaging while driving will keep drivers' hands on the wheel and their eyes on the road, making our roadways a safer place for all Californians."


Like i said before if you are getting upset about this law passing you are probably one of the people they wrote it for. DOnt do it and you want have to worry about it.

First offense is $20. $50 for subsequent offenses per ca.gov. With addition of penalty assessments it's $76 first and 190 subsequent so in theory you're both right.
