Insurance problems - need some opinions...

Insurance problems - need some opinions...

Sup folks, just want to get your opinions/insights on this "problem" that my gf is dealing with, with Mercury.

Last April, her car was hit by another car while backing off of the parking lot. She was more than halfway out of where she was parked when some old guy in a Lincoln hit her car. Guy claims she's at fault, so they ended up getting each other's insurance and driver's license info to make their claims with their insurance companies.

Her car was repaired, and her insurance adjuster said that both parties are claiming the other is at fault, so she will just have to split the deductible with Mercury while the case is being fought(?). Mercury ended up covering for her entire deductible.

Fast forward to today......suddenly, a new insurance adjuster is assigned to her (suprise, it's still open!) case. The insurance adjuster now claims that it is now her fault "since the law dictates that you should give right of way when backing off of a parking spot". Here's the fun part -- apparently, the insurance adjuster hasn't even seen the other party's car yet. They still have yet to "assess" the damage, but this adjuster is already claiming that my gf is at fault........nearly 2 months after the accident.

Anyway, this whole thing doesn't sound right to me, at all, so my gf and I will be doing some research. I just want to see if any of you guys have dealt with something similar, or if you have any suggestions or insight on the matter. Thanks!!

I would double check on that whole right of way deal, as far as I know if it is in a parking lot, there are none.

I got hit when I was backing out of a spot and the guy admitted it was his fault. Oddly though when I contacted my insurance to file the claim, whom I also called from the scene, they said that there was a claim against me! I had good photos of the scene and when I combined that with Google Earth it clearly showed that he was cutting across parking spaces to get out of the parking lot which is why he rammed me.

I need to check why the photo links aren't working (but I can't do that at work).

The links from Google combined with the photos I had showed that he had cut across a couple of parking spaces at the end of the row to try and get out to the "Keep Clear" section on Camden before the traffic light changed and traffic started moving.
