Your reasoning seems to say that you are entitled to break the law because you felt like it. You felt threatened by his big scary truck so you decided to break the law and speed, then you break the law again by trying to pass a car on it's right side, and then you have the ***** to call it entrapment when you get a ticket for it?

You should have shifted right, dropped back 20 yards, and let the truck be someone else's problem. This is goddamn America, and the guy wants to speed like crazy in his truck. He's nice enough to do it in the left lane like he is supposed to. And while it's annoying and his bro truck pisses you off, that doesn't mean you can break the law just to stay ahead of him.

I would just pay the ticket and do traffic school. It'll cost you like $150 total or something. 10mph over the limit isn't too expensive. However, if you want to fight it..

I would fight it. Did he clock you with a radar gun or with what? I would ask for calibration dates...I won a case like this the gun wasn't calibrated fully (off by 1 mph officer said) enough for me to complain to the judge and got away with traffic school and no fines at all...and also by fighting it you already have a 50/50 chance of winning, its a gamble but I'd do it

Too many people don't move over. I can be going 80mph and see someone coming faster and I move over before they're anywhere near me. If more people checked their egos traffic would flow better and there would be a lot less road rage.
But I wasn't holding traffic up.. The Saturn was. Neck to neck with the slow lane driver. Not until I got a chance did I switch lanes ...

Just state the line "I feared for my life" and the reasons. Winding road, tail gating, high beams. And state that due to you fearing for your life, your thought of just moving over would still put you in harms way.

You still broke the law. The justification is in the judges eyes if breaking that law was worthy of you stating your life was threatened =P.

he seems to have already admitted to breaking the law verbally



I recommend just paying the fine and getting on with traffic school.

The Saturn was driving the same speed as the slow lane, there was a car to my right.... I soon as that car exited I switched lanes but so did the truck. I guessing he tought I didn't want him passing anyone or that I cut him off but that's not the issue. I switched lanes when I wad able to, to allow the truck o ride bat satur till it switched lanes. But no he just continued to do the same.... That why I sped up and moved back to the fast lane that wen the 5-0 saw me...I was sure the chp was gonna pull the truck over for the high beams but instead went for the guy who drove 75mph..

Oh yeah, one question. What's the CVC you got ticketed for? Obviously this will determine the best way to fight the ticket.

i just got out of courts yesterday in hayward , and the one thing i think that was most common was that all people that were there just were not very smart about fighting there ticket . its not what you know its what you can prove. and all the people there were like duh i wasnt speeding or driving unsafe, and the judge would just ask the officer and the cop would just deny or give his opinion.

only one guy came close to a dismissal where it was a guy who was a project manager for the work going on on mission blvd was driving 30 in a 35 in the fast lane checking out his project. the cop gave him a ticket for to slow and the guy was saying that he was justified on driving slow because of pot holes and that he had photos and proof that the speed limit was now set at 30 mph there and of the construction he was looking at( his jobsite ) and pot holes. the judge was just about to dismiss that case when the cop looked at the photos himself and said there is no date or anything saying where these photos are from. and the judge reemed the guy from there saying you have to note where and when those photos are from because i dont know i those are from Alabama or if those are pictures from today when the work is obviously there.

so just cover your arce and if you do go into the courts fighting the ticket and prove what you know. if not you will have wasted time by going to court. if you go into court saying that the guy was being unsafe by tailgating you he will ask the same thing everyone else is saying you should have just moved over and slowed down and onto what you said he could have gone around too
and that will go back and forth for a while. and he is just going to go with what is proved . that you were speeding.

sorry man this is just a loosing battle and some bad luck but i personally would just pay it and take the traffic school.
