He's a terrorist, no doubt. The only loophole he can hope for is that he never intended to fight the US...I don't know if he was caught actually fighting the US or not, but I do beleive that his intention was to fight in local battles in the middle east, not against the US. Either way, he is an idiot for joining a fanatical militant religious movement.
