2nd gear went out. HELP!

I am new to the forums but have been driving my car for about 2 and a half years now. I posted this on Nasioc as well. Well... here's the story: I was driving my 2002 wrx a couple of days ago, and as soon as I shifted shifted to 2nd at around 6000 rpm I hear a popping/clunking noise. I had the car towed to the nearest dealership and they told me that my the teeth were stripped from my 2nd gear. I don't know exactly what this means but the dealer won't fix it under warranty saying that it was an abuse on my part. I find this hard to beleive cuz I just merely shifted to 2nd gear and take care of my car pretty well. They estimated the total to be around 4200-4500 dollars.
I have around 36,000 miles on the car and have extended warranty coverage. I had the clutch replaced about a month ago for the clutch shudder under warranty.
I have read a lot of threads of people having problems with their trannys and the dealer denying them warranty repairs. Does anyone have any advice on what I should do. I am pretty mad because I am convinced that I did not "abuse" my car. Any advice would be greatly appreciated.

If you look down the posts on this page dude (which you probably already have) There's a guy who just won a small-claims court case for his tranny. Maybe if you site his case at the dealership and act like you'll take this to court if you have to they'll think twice about denying you again. I dunno, just a suggestion. Good luck though!

btw, was that an up shift or down shift? I assume it's up shift, cuz that would be pretty crazy to shift from 3rd at 6k into 2nd
