would he be at fault? cop said to report everything to both insurance companies.. i'm fully covered but the last thing i want is to have the blame pinned on me

Usually if somebody pulls out into your lane, they're at fault, but don't quote me on that. A lot of times it's faster to go through your insurance company, but the only downside to it is that you may need to pay your deductible. However in the end if it's found that he is liable, they'd reimburse you any out of pocket expenses. What insurance companies are involved?

you're right...99% of the time, regardless if they pull out and you hit them it's your fault.

ouch... that looks a bit more painful than my rear-ended 06... sorry to hear about / see it. Guy was backing out / or pulling out of his driveway/house, then he's definately at fault.

If you weren't speeding, and this was in a residential area, it's likely that you had right of way (most likely anyway).

if this was on the road, changing lanes or something I'd agree... but according to the OP, pulling out his house... meaning merging into traffic, usually is a "right of way" item isn't it?

I've been wrong before. and I hate car accidents anyway, so I concede I'm not the insurance agency or the law... I'm probably wrong...

if he's pulling out of his house "through" traffic has the right of way

I think pete will win b/c it is his job to keep his eyes on the road not to watch ppls coming out of there house

and it is the job of the person pulling out of his driveway to make sure that the road is clear befor getting onto a main road

people just can't drive...it's always "you can go, just right after me" here. If i see someone trying to pull out of an area with a lot of blind spots i usually extend the courtesy. Just tell the judge you saw him throw a beer bottle out of his car...
