that sucks dude. my car got jacked up pretty bad about 4 months ago...some jackass in a jag rear ended me....14k in damages.... i took it to sturken auto and they made it look like new. They even fixed a few other scratches i had not from the accident. The guys there are cool, they're a top notch shop. Sorry to hear about your misfortune but I'm glad you're okay. With regard to insurance I would advise (as others have) to seek counsel if the insurance company doesn't offer you a fair deal. Do not accept the first offer the insurance company makes, delay it as much as possible. Often injuries don't show up until a little bit of time passes. The insurance companies know this which is why they're often eager to reach a settlement ASAP. Sounds like you'll be fine but it's still a worthwhile precaution.
Also, don't get too greedy (some people get caught up in the whole process). Take what is honestly owed to you. The other guy was at fault and as a result of his carelessness you're without a car and have to deal with this whole fiasco. They should cover all of your hospital bills, replace your car, and you should also get some money for pain and suffering. You should get an equivalent value car out of this. If the insurance company doesn't replace your car with something in equivalent condition, and of equivalent value then refuse the offer. This will get the insurance company really nervous, the longer you wait the more anxious they will be to settle (they're afraid that other medical issues might surface as time passes).
If you don't think the insurance company offers you a fair deal seek legal counsel or talk with your insurance company, they may rally for you on their behalf (they may even sue his insurance company on your behalf). Also, I'm not a lawyer so my advice may be really crappy (there's the disclaimer).

And just so you know, you're in for at least 6 weeks of driving a shltty rental car. Just make sure you keep the receipts and make him pay for it.
oh and i don't know if you know this, but you should really pay attention for any pain in your left kneecap the next couple days. there is a small chance it could be from the accident you were in.

IIRC even without uninsured motorist coverage, they still have to repair your car, but I think ur rates go up if that happens...anyways if its 80% of the value of the car they should be totaling it, if its under 80% u can expect it to be repaired, there is really no way around that, just make sure u take it to the body shop YOU are comfortable with, because u are entitled to that no matter who you are insured with...
