I was driving down Peralta in Fremont, stopped at a light when Rosette on his bike pulls up next to me and signals me to pull over. Asked me if I knew what he pulled me over for and of course i said no. Turns out he didnt like my carbon fiber side markers. Then he asked for me to pop the hood and i asked why, he told me since i had an exhaust he needed to check what other modifications i had. He didnt see a cat on my down pipe and asked if i had any, which i have one gutted on my midpipe. He got mad at me because he had to lay down to look under the car. Ended up writing two violations, one for modified amber turn signals, 26101VC, and Modified exhaust 27151VC.

Now i have one question, Rosette said that a second offense on 27151VC, modified exhaust is 800 dollar fine and a moving violation, is that true?

I've been avoiding Rosette for a long time and he finally got me.

(a) No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of the vehicle so that the vehicle is not in compliance with the provisions of Section 27150 or exceeds the noise limits established for the type of vehicle in Article 2.5 (commencing with Section 27200). No person shall operate a motor vehicle with an exhaust system so modified.

(b) For the purposes of exhaust systems installed on motor vehicles with a manufacturer's gross vehicle weight rating of less than 6,000 pounds, other than motorcycles, a sound level of 95 dbA or less, when tested in accordance with Society of Automotive Engineers Standard J1169 May 1998, complies with this section. Motor vehicle exhaust systems or parts thereof include, but are not limited to, nonoriginal exhaust equipment.

hold on, hold on...you're in an 02, and you have the lights (which stock don't blink on 02s) switched out for carbon fiber covers/ducts? And he wrote you up for that? Fight that one, cuz they don't blink from the factory anyway.

btw, who is rosette? code name for cops or is that a particular cop?

Doesn't matter if they blink or not. Markers have to be primarily orange or amber in color.

but it's the side ones, they already have them on the light assembly that blink, the others are for looks (I think...)

My fronts are clear as well, but if side ones aren't for turning signal i should still be able to fight it

If your car comes equipped from the factory with amber side markers, they must be present and amber. Can't remember where I read that.

The correct CVC is 25950(a)(1) - you are not legal under that:

25950. This section applies to the color of lamps and to any reflector exhibiting or reflecting perceptible light of 0.05 candela or more per foot-candle of incident illumination. Unless provided otherwise, the color of lamps and reflectors upon a vehicle shall be as follows:

(a) The emitted light from all lamps and the reflected light from all reflectors, visible from in front of a vehicle, shall be white or yellow, except as follows:

(1) Rear side marker lamps required by Section 25100 may show red to the front.

(2) The color of foglamps described in Section 24403 may be in the color spectrum from white to yellow.

He wrote you up under:

"26101. No person shall sell or offer for sale for use upon or as part of the equipment of a vehicle, nor shall any person use upon a vehicle, any device that is intended to modify the original design or performance of any lighting equipment, safety glazing material, or other device, unless the modifying device meets the provisions of Section 26104. This section does not apply to a taillamp or stop lamp in use on or prior to December 1, 1935, or to lamps installed on authorized emergency vehicles."

Which you did - you modified the existing safety device.
