It flat out blows my mind that there are people out there that can take a situation like this and try to say anything even remotely suggesting it was not completely the motorcyclist's fault. Even to ponder what the car was doing is insane. Here's some jackass that killed a couple people that are most likely very missed. Their crime? Sharing the road with irresponsible people. WTF was this idiot doing 250kp/h for? Who knows. Just a damn shame he didn't simply kill himself.

It's your fault if you rear-end someone because when you hit stuff that's IN FRONT OF YOU, you are going too fast for conditions. You are not supposed to hit stuff. Why is that so hard to understand?

When I was little, a drunk driver running from cops (like that guy in santa clara) killed my mom. Maybe this hits home for me or something.

sorry to hear about the loss of your mom. I lost mine to MURDER 10 feet away from me at 10 years old. So I know where you're coming from as I view drunk driving fatalities as murder.


as for the rear end thing...I have to disagree. 100% disagree.

If I'm doing 65 mph in the slow lane which is 100% legal and that is the flow of traffic and someone cuts in front of me going 45 and I hit them...it is NOT my fault. It is the law that you are required to get up to the speed of the traffic to safely murge...No matter what the speed is. I've merged onto freeways at 80mph plus right in front of cops and slowed when it was safe to and not even gotten a second look from them.

If I'm driving down the street at 45mph and a car is not paying attention and back out of their driveway right in front of them and I nail them..it's not my fault.

There are far to many people that do not pay attention when they drive. They want to change lanes they do it. They want to merge they do it. They want to back up, whatever....they do it. Talking on cell phones. Or just not giving a **** that there are people on the road around them. This not only puts others at risk but them as well.

You should be aware of people around you....you want to merge..check your mirrors. It's not that hard to see a car/bike coming and go...wow..that guys halling ***, I better let him go by then merge. I do it all the damn time. It's not that hard to be doing 70 in the fast lane and see a car coming up on you doing 85 and say..hmmm.. I should let them go by.

In saying all this I do not think it's those people's fault that accident occured. I think some idiot got a bike. got his lisense and was riding like a retard. Unfortunately he had to take two people with him that most likely didn't do a damn thing wrong.

But really..we don't know that do we. Obviously it's the bike's fault. but who are we to know that those people in the VW didn't blow a stop sign or a stop light or just not see anyone...or not even look for anyone and pull out in front of the guy going 10mph.

I've seen it happen. That's how the guy I knew died. And just like his death was his fault..this accident was the bike's fault. Doesn't mean the other party didn't contribute to the accident...that's all I'm saying.

So don't get all hostile.

Not getting all hostile, merely expressing an opinion on an internet forum.

Dude, I am with ya with the people on phones, people merging into you etc. But, if you hit something, or rear-end someone, it's your fault and IMHO, that's how it should be. If some moron on the phone plants his H2 in your path and there is nothing you can do, that's a different story and I am SURE if the police report were done correctly, THAT person would be at fault. However, driving on the roads here in the Bay Area includes dodging obstacles. It is your job to make sure you don't hit any of these inept idiots. You KNOW this happens every day. Trying to pretend that the lanes are yours and that these people aren't out there in every 3rd car is like sticking your head in the sand. If you want to drive fast and be around people who also drive fast and do it well, you are in the wrong spot.

This is another topic, but IMHO it's criminal negligence for it to not be a serious crime to drive around holding a phone to your head. Over the last week, the closest calls I have had have ALL been with SUV drivers on the phone. I have seen some ***-spackler take his hands off the wheel to do hand motions while on the phone. Basically, CHP's stance on cell phone usage shows me how serious they are about the safety of people, and how much more meaningless speeding tickets are.

Anyway, the point is - you are right - people never use any windows in their car, and rarely use the windshield. No one gives a crap about the person behind them and people ALWAYS drive like they are asleep. But you know this. It's your job to dodge them if you want to be an 'above average driver' in the Bay Area. This is a part of why I shipped my Celica yesterday, am shipping my Suby tomorrow, and moving back home to Hawaii on Tuesday. I am Bay Area'd out.

Back to the subject, dude, the people in the VW could have beens stopped in the middle of the road in a nose picking contest and still that doesn't excuse the motorcyclist from going 250kp/h.

agreed. I think it was the bikes fault. Was just saying that **** happens like that with people not paying attention all the time. 150mph is stupid to do anywhere...even on the track..but hell...I'll admit that I've done stupid things before.haa.

as for the cell phone thing. I talk on it every now and again but I don't like it. I'd prefer they make it illegal and actually enforce it. Like a seatbelt ticket. Get one it's like $35. A second...$70...third $140....etc. Eventually people will put the phones down or get hands free kits.

IMO it's a damn shame that kits aren't made affordable or as reasonably priced options in new car. The kind that you plug your phone into and you can push a button the steering wheel or center column...etc....it would be much safer and it's really not that expensive or difficult to do. Just a perfect example of not doing something cause you're not expected to. Lazy frickin american business'.......side track...perfect example is in japan.... our fastest internet speeds are their average. Korea. They're cell phones can do as much as our computers. The technology is there. Our business' are just too freaking greedy to take advantage of it. DSL should be as expensive as our dialup is.

oh....police report and hitting someone that does something stupid and you can't avoid them...that's my beef. Our law enforcement are sadly very stupid....or just don't try. if the book says it, it must be. It bums me out. I come from a family with A LOT of law enforcement in it. It's not their fault..it's the system. Anyways. Perfect example.

1998. Dude runs a red light and me going through my green nails him. $10k in damage to his POS and totalled my truck. Guy gets out. Passenger says the driver is loaded. Eventually they take off...with my lisense plate. I call the police...at about 10:30pm. They show up at around 1:15am. End up finding the guy and doing a breathalizer on him...i'm like...dude it's been 3 hours. I'm sure he's not drunk anymore. Guy was clearly on something. He thought the cop was me. When the cop showed up he lost it. He thought he fled from an off duty cop. Well the cop was about 5'6 or 7 and 140 pounds. Light brown hair. Clean shaved and medium length hair. At the time I was about 5'10.5. Huge gotee. Piercing. SHAVED head and weighing in at a decent 215 220ish.

They let the guy go. Wrote him a ticket for fleeing the scene.

End result....they said the accident was my fault because I was driving at an unsafe speed and I entered an intersection when there was a car in it.

The police report had me going between 38-42mph. It's a 40 zone. And we hit in the dead center of the intersection...on impact I was doing about 5-10mph...him 50-60.

I had one of those accident reconstruction companies work the number.

Cops ****ed up. I lost my truck. Was hoofin it for like a damn year before I could afford another car. And those bastards cleaned the insurance company out. Got new rims and what not when I hit them in the middle of the car.

so I guess like your alcohol...dumb asses cause accident things...I'm biased...justifiably so.








In short....I'm feeling what you're saying.

it was cleaned out then put back together as an example of what can happen when you get stupid on a motorcycle....says in the paragraph.

Well I have done stupid things before, and I try to be very aware of motorcycles around me because a lot of drivers DONT and WONT SEE YOU!!! Come on they beat this into you during motorcycle training. Unless you have a siren and lights going they wont see you till it is to late.
I have known way to many people who get out on public roads and push their bikes. I like motorcycles, and do my part to try and share the road as much as possible. Lets just say since I don't have pictures of the intersection where this took place I won't call fault. For all we know there was a bend in the road 75 yards up and the car driver was slowly crossing to make a left. It is possible they never saw him coming..

What I can say is that his speed was WAY to fast! period...

As far as leaving the seen of an accident:
Next time complain to the cop you have neck pain and need to see a doctor right away.
Even if you don't this classifies it as an injury accident, and them leaving the scene makes it a felony end of story.
He would have gone to jail even if only for a night.
Now if he ran a red how in the heck do they figure it was your fault. I mean you look at skid marks paint transfer, and damage it isn't that hard to figure out...

Oh yeah that car was probably scrubbed down pretty heavily. I don't even want to think how many liters of blood, and bits and peices of flesh they washed out of that thing.. I have seen some pretty bad accidents, and let me tell you they are never clean...
