Help!! (re:Bank of America)
i know someone from boa that could help, but I don't know if he is willing. I don't know your banking situation, but i recommand you do what i do or something similar. i have checking and saving and i ALWAYS leave $100 in checking just incase. My bank (bank of the west) would also take money out of my saving to my checking if there is NSF, for FREE! Use credit union (Bay Federal) for your car load (low interest rate).
I used to have boa becaues they are EVERYWHERE. So I would have boa for ATM mainly and Bank of the west for everything else. Until they (boa) tried to charge me and saying my balance was belowed limit (I had 1k in it). It was a student account (min balance was $30). I walked into the bank the next day and closed my account. They asked me why, I said "boa sucks *** good for nothing piece of **** charge me for no reason!". Took my money and walked.
I'll give me friend a call and see if he could help...

I just finish talking to my friend (David). He used to be a teller/csm or something, but now a loan officer at boa. But anyways... He said that boa should not have cashed the check in the first place. Was the check dated 180 days before the cahsed date? If that is the case, tell boa that and they should investigate and eventually the teller that cashed the check would take the hit.
since he is doing loan stuff now, he has no access in that area. but he still knows people that could do it. But that would require your account number and stuff. I would assume you don't want to give that out so you would have talk to boa yourself.

David called me back and said to call this number and ask them to open a case (after you tell them what happened, mainly the check date was more than 6 months ago).

hey virus. thanks for your ideas. (and your friend david). i called the #, and they said that there is no time limit on a check if you have written it. The said that once written, it can be cashed whenever...so im kinda screwed i guess. but oh well...thanks anyway. and thanks to your friend brian.

I had an incident with bofa a long time ago that made me avoid them.
It didn't help though, they still got me when I accidentally sent my car insurance check to SBC and my SBC check to my insurance company.
SBC took the check that was NOT made out to them to bofa and bofa cashed it. Bastards. Now I have $800+ of credit at SBC. It'll take me two years of phone bills to work through that. They said they'd send me a check back, but over a month and nothing so far.
I called my credit union, and they said the responsibility of identification is on the bank that cashed the check. in other words, bofa screwed me and I'm not even a customer. Argh!
Get a credit union, way better. But I have to say that even if you have a ton of money in the bank, they still don't treat you much better (besides the fact that you never incur monthly fees or NSF fees)

David and I don't know those people, they are just regular customer service people. If that's the person, David could bounce an email to that guys manager, if you have his name. David said he could take care of this for you but he needs your info. There are things you could do. He said it's okay for you to give him a call at his office (650-867-8475). He also said he knows someone at a branch near you (Danville) and should be able to help, but not sure. Give David a call and keep us posted!

Glad to hear everything worked out - I also hate the BofA fee structure but the only other major bank I can use is Wells Fargo and they are even worse than BofA, much worse in fact.
I would suggest getting an overdraft line of credit - it runs around 19% annually when I trigger it, but I don't use it normally and I always pay it off immediately so it only costs me $2-$3 each time I hit it.
