Accident. Help.

Any of you guys out there with insurance knowledge please chime in.

so my friend got rear ended and she hit the car in front of her. the insurance of the person that rear ended her is saying they are not liable for the damage that her car did to the car in front of her so she wants to sue.

is it worth the money and time?
is she liable for the damage done to the car in front of her even though she would have never hit them if she hadnt got hit?

she needs to file a claim with HER insurance company and let them deal with the other persons company. you pay insurance, and they are supposed to step in

if the hit from behind was hard enough to send her into the car in front of her, then yes, they are liable.

plus, she needs to go see a doctor and get xrays on her neck to be sure she's OK. and get physical therapy if needed. i'm sure the other guys insurance won't want injury settlement

did she get an accident report from the police?

the insurance company is going to push you around because they can. get your insurance company to get involved because they dont want to pay =)

this is correct. however, it shouldnt effect her premium

Was your friend at a complete stop when she got hit, and did she have her foot on the brakes while she was stopped?

The same thing happened to my little brother when he was stopped at a red light. A Hummer rear ended him hard and his car smashed into the one in front of him. He did not have to pay for any of the damages because the person in the Hummer had to pay for damages to both cars.

i slammed my truck into a minivan. it hit a car, which in turn hit another.


i was only liable for the vehicle i hit since CA is a no fault state.

Just out of curiosity, if you're at a complete stop and you don't have your foot on the brake, does that change who is liable for damages?

if you hit a car in front of you, it means you were too close and its your fault, even if you only hit the car in front because someone hit you from the rear. I'm not saying that a judge/jury would not rule in your favor, I'm just saying that is the generally the bias; circumstances of the accident may change that bias however.

had something similar happen to me a few months back. was a three car accident and my wife's minivan was in the middle. the car hit us and in turn, we hit the car in front of us. my story was that i fully stopped before the car rearended us and caused us to hit the car in front of us.

get your insurance involved for sure. you should specify that you stopped in time and that the car that rearended you pushed you into the front car.

and good call on getting checked by a doctor. sometimes, things doesn't show up until much later.

i;m in the inzurance biz.....Definitely file a claim with your own insurance and tell them the story......She;s not liable for anything unless the story isnt the way it really happened.....

its all going to depend on the adjusters from each insurance company.

my mom had something similar to her happen everyone involved had state farm except the person who hit my mom 1st. they deemed that the person who hit my mom was traveling so fast that they were reponsible for all 5 cars involved.

i was at a complete stop when a car going about 15mph hit me from behind... Mercury Ins. said i was at fault because my car didnt have ABS so i should have left more space between me and the car in front of me. WTF right? the car in front of me was illegal and so was the driver....

if there was a police report it should have all of that included.

Hopefully your friend is ok!

and if that happens you contact the insurance commissioner for the state of california

a long long time ago, state farm gave up and decided to stop helping me fight an open claim. I had to get the insurance commissioner involved, and they were going to fine state farm for the breach of contract.
after that, they were more than happy to help me

you pay insurance, and you pay for them to help you.
