Actually it can be thrown out, I had a 2 door camry according to SFMTA, I claimed they had the wrong car and it was thrown out instantly.

You should be fine. I don't think they'd even total it out at $3000

if you know for sure you weren't at fault. Fight it. Because why would you want to settle for a point on your record when you didn't do anything wrong.

It depends whether you buy the car back from the insurance company of not. If its totaled, they will ether pay you the full amount, or a lesser amount and let you keep the car (If they keep it, they'll sell it for super cheap to some junk yard). If you let them keep the car, no, you cannot take any parts off. Generally, it is worth keeping the car and parting it out yourself, because they won't give you even close to its value. But if the idea of parting a car out yourself is daunting, then just take the money and let them keep the car.

FYI from the pics, I doubt it's totaled. All those panels are easily replaceable. It just depends on the frame, and IMO I doubt its not bent.

Im still confused.

You both stopped at the stop sign at the same time?

And then

You went through the intersection (she/he did also) and struck you without braking? (assult with a deadly weapon?)

You went to the hospital with injuries?

Person claiming your headlights wernt on even though we have daytime running lights.(technically you still need to throw your headlights on, so they got you there)

cop writing wrong info?

They don't total the car only if it exceeds KBB value.

My 1 year old WRX was totaled with $13k in damage. It was worth $21k at the time.

Wrong. I stopped at the stop sign and she was slowing down. So I went and apparently she wasn't paying attention and ran it.

My lights in my wrx are wired differently. I have them on a setting where when I start my car they are on. Even if it is 3 in the afternoon so they didn't get me there.


Cop spelled my name wrong, said I own a 2 door coupe, and had the story wrong. Stating she was vehicle 1 and stopped at the stop sign and collided with me. When she ran the stop sign and t boned me. Make sense now?!
