As long as you're insured against uninsured motorists, you should be okay. And yeah, sue that guy for every last penny he has. Take his POS wagon too

that might fail, and fail badly in your (cross your fingers...) next accident.

and yes, sue the guy in civil court.
doesnt WA have a law requiring everyone to drive with insurance????

that's good that you have some sympathy. i don't own a subaru, yet, but when i drive my stick shift i usually don't hold the brakes in at the red light. i leave it in neutral. after that i usually look in the rearview mirror. if i see a car pulling up behind me, i press the brake until the other car is perfectly "still" behind me, then i let go of the brake as well. i guess those brembo's are to be praised. good luck with everything.
