when i was young and stupid, like 16-17 years old, i drove a family owned 95 camry. i usually drft through this one corner in my neighborhood everytime i approched it, and i knew the street and the car very well. one day, after i've drifted through that corner, i saw a cop car was there parked at the corner exit!!! there was no lights, but the cop put his arm out of the window and pointed pointed his finger out to the left of the cop car. so i stoped at where he pointed at (he's still in the car), so he asked me what was i doing, and i told him i thought i was supposed to turn on the next corner, but just realized it was this corner i was supposed to turn into at the last minute, so just hit the breaks a little late. he just told me to becareful and drive slower next time, and i got off the hock from drifting right infront of the police, ahaha lucky me~.~

The Basic Speed Law, CVC 22350, states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of the highway, and in no event at a speed which endangers the safety of persons or property."


Section (b) of Speed Law Violations, CVC 22351(b), states: "The speed of any vehicle upon a highway in excess of the prima facie speed limits...or established as authorized in this code is prima facie unlawful unless the defendant establishes by competent evidence that the speed in excess of said limits did not constitute a violation of the basic speed law at the time, place and under the conditions then existing."

i.e. if the road conditions were favorable, then there is no reason that you couldnt have safely been driving xMPH ... I used this defense on both of my most recent tickets - One was for 70MPH and the other was for 80MPH. BOTH on the 118. I have since received a NOT GUILTY verdict on the 80MPH and am still waiting to hear on the 70MPH one (I just turned it in a little bit ago). I figure if I won the 80MPH, then the 70MPH is in the bag .
Its funny becuase I had told a cop friend of mine about my defense and he commented by saying, "Oh yeah well... We generally dont tell people about the prima facie speed limit." haha

 

Actually, it was right before the tampa exit... now i know that on the 210 it is pretty much fair game for whatever ... then up to the 118/405 interchange you can go about 80 .. but once you cross the 405, you better not go above 75 or you WILL get pulled over! I look EVERY day and I have yet to see where those bastards hide... you never see them until they are pulling you over!! grrr

 

I was just recently found guilty of "speeding in excess of 100mph" in Kern county. The fine is $637 and a 15 day suspension of my license. Hopefully you can fight it because otherwise this is about what you are looking at in terms of your fine and punishment. If you can't pay the fine you can set up a payment plan with the court to pay it off and if they suspend your license you can get it restricted so you can drive to and from work.
