Your insurance company is liable up to the amount of your policy limit if you lose. Talk to them about covering your legal fees as well if this applies. My wife got sued a few years back (before we were married) and AAA picked up the legal fees and would have picked up the bill if she had lost (which she didn't because the plaintiff was a dumb ****).

so it sounds like it wasn't a bad accident at all since your car only had a busted license plate frame... they're probably going after nuisance money from you / your insurance company.

i believe if they cashed the check from the insurance company that would mean they accepted the terms of the repair and can't go after you personally because you fufilled your end of the contract. Maybe you should slap em with a countersuit for legal fees and the cost of your lisence plate frame, maybe add a lil more for lost wages and emotional distress.
