The trigger puller would be charged as first degree murder if the plan from the get go involved murder. If it was an on the spot reaction, second degree could be charged. One thing i've learned most about the law is how much it looks into the state of mind during the crime, and for some cases, the before and after of a crime.

If the look out guy knew about he gun, but didn't think it would be used possably could get away with 3rd degree, a.k.a. Recklessness. 1-2 years behind bars, 5+ parole.

If he went with "i didn't know about the gun" he's have to prove by what means the robbey would have taken palce first. and as always, prove the "Why"
once again, state of mind.

Boo. Thats like being blamed for a murder that happened next door. You go next door and ask the people for a cup of sugar. Then 2-3min later someone breaks in and shoots the neighbors. You try to help out and in the end result be charged with murder.

Is the example i gave the same idea as your scenario?

Agian, i thought manslaughter was when you ran over or hit someone. I promise to The Lord. If my friend goes to jail for longer then 2 years. I'll be fighting this case monthly. I am going into Forensics.

If you friend claims to not be the other party involved with the street race, it will come down to witness reports. What kind of car was the black one?

I dunno. I only got limited information from my friend. He was only able to talk for a couple minutes. I can't stand the local news. They are douche bags 100 fold. But not 10 min after i was talking about it with my other friends. This black 97 eclipse kept going back and forth 3-4 times. Not in front of me but down sunrise around the area we were at. Then a black EVO sped away and a black STI did the same. Its confusing lol.

If he raced he was part of the crime. If he was in fact the person that was racing the Mustang that crashed I hope he gets locked up and they throw away the key. If he was truly not involved in the street race, I hope the record is set straight.

i almost got into an accident tonight on 80W and im never street racing/freeway racing or passengering again. i wasnt driving, but i was in a passanger and to make a long story short...my friend went into 2nd instead of 4th and fish tailed on the freeway and he just let off the gas and steered...lucky for us there wasnt anyone around...he was racing a local iclubber that will be anyonomous. please keep it at the track folks

the 22 year old said he was not racing with the guy. the guy in the mustang came up on him fast and was changing lanes and lost control. innocent till proven guilty. besides if he was racing him second-degree murder is way to harsh of a penalty.
