No aftermarket HID kit is DOT legal. In fact it appears that the NHTSA has recently issued an official ban on their sale with fines for dealers who don't comply. I haven't seen the actual document but there have been many posts and references to it so it's presumably real.
It's not just HIDs anyway, any modification to your factory lights, or replacing them with aftermarket ones (including Subaru JDM/EDMs), is not legal.
Chances are that unless the area you live in is especially strict about such things you won't have a problem as long as your lights are sensibly aimed and you don't use any high beams or driving lights unnecessarily.
Actually legality-wise there are a few different things to consider-
- DOT legal, or federal standards for new and aftermarket vehicle equipment. Not really an issue, much of the stuff we buy and install on our cars isn't DOT legal ("off-road use only,etc.). Not generally enforced at a local level.
- Your local laws and vehicle codes. This is what you most need to be concerned about with regard to anything visible/audible you plan to install on your car and how it is viewed by your local authorities. May coincide with DOT standards.
- Inspection. Related to local vehicle codes, in states/localities where safety inspections are required some aftermarket items may cause you to fail. Varies considerably, in some states changing your headlights may be no problem at inspection time, in others you'll fail. If it's an issue in your state keep your stockers handy.
