It's an HKS SSQV, so they don;t get much louder than that...haha. But, point taken about the length of time. I guess I was thinking that he might own up to it, but he didn't. Personally, I would've, but that's just me. I'd have a hard time going out and seeing him at Ala Moana and thinking to myself that I took your money and you have nothing to show for it, other than a piece of useless metal. 2 months later or 2 seconds later, it's still amounts to a broken part.

Damn B. I really feel your frustration. If it was sold broken (not as advertised) then we don't need people like that trolling these boards. I hope his conscience gets to him. If it was never installed, you would not have known. I guess buyer beware. Rest assured any transaction with me will not end like this. But people must not take advantage of that generosity. G/L with whatever outcome may be positive.

the real question is did he say it worked or not. unfortunately you can't argue that because he didn't say it was broken, that it means it works. Sellers are always selling things to make money, therefore its the buyer's responsibility to find out all information about whatever product before buying, no matter what it is or who its from.

Well to be honest, I don't break it down that way and ask if every part I buy works. I generally assume that I'm buying a part that works. Most people don't sell broken parts. With this particular case, he did tell me that he bought it from another guy, and he did say that he never installed it. Nonetheless, it was still broken. Oh and by the way on your last post, you said you wouldn't respond back to me if I "told" you I wanted my money back.......well, I asked nicely on 3 separate PM's prior to that. He was nice and cooperative about the whole deal up until I wanted my money back for it. He wanted ME to call the guy who he bought it from and ask him for the refund. Why the heck would I call that guy......my only dealings were with this guy? My beef ain't with you. To be honest, it's not even really with this guy. Yes, he did sell me a broken bov. Yes, it was sold as is, but wouldn't most reasonable people assume that the seller is selling a part that works? And yes, he's not going to refund my money. But I'm hoping that others may benefit from this and not ASSUME that all local buyers will take care of each other.

OK yeah then it's broken

Just to play Devil's Advocate though...when he sold it to you, he did think it was working. Then the time lapse in which he sold it and you found out it was broken was too long. Other dude has a point too about the 30 day thing at real stores. Even if he did refund you, then he's SOL from his prior transaction and I'm sure the dude he bought it from wouldn't refund him.

Anyways, it still sucks that you have a non-functioning BOV...that blows, or not.

Well there you go...lesson learned, don't just assume that because someone is local that they will bend over backwards for you.

I'd have to agree with MBasile. As the buyer of a USED part it is your responsibility to test it within a reasonable amount of time to insure proper function. If you would have came at me 2 months later I would have looked at you like who are you to ask for a refund after all this time, I don't know what the hell you have done with it in the past 2 months. I say you are just going to have to eat this one and learn from it. Just my 2 pennys............

Haha......"that blows, or not" Funny!

Yeah, there's no way around it....the situation sucks. He did sell it, ASSUMING it would work. That's the same way I sold it, ASSUMING it would work. The only difference is that I wouldn't sell a part that was broken, whether I knew it was or not, and then expect the other guy to suck it up. I would take it as MY loss, since I sold the part to somebody else, because I don't want my reputation to suffer.

As for the "30 day thing at regular stores", the analogy of buying something new at a retail store is not the same thing as buying a used car part. Oh, and by the way, most big retail stores (Walmart, Kmart,Target.....check their websites) offer a 90 day return policy, with some retailers like Macy's offering a 180 day return policy. So the seller can't really use that in his defense (which he did try in 1 of his PM's). But, oh well, Sh-t happens huh?

Oh yeah, I'm eating it alright. LOL! I hear you about the whole 2 month thing. I know it was while. I know he sold the bov that I traded him about 2 weeks after, so I wonder if even after 2 weeks I was destined for doom! Would I have even been able to get a refund after 2 weeks, since my bov that I traded was now gone? Oh wells, life goes on.
