Just got a speeding ticket

Just got a speeding ticket

I'm driving home tonight on 680south doing a constant 70-75mph (max) with the flow of traffic (which isn't much) I move to the far right lane to get off at my exit, when a cop flips his lights on, pulls me over and says he was pacing me from 84-95mph.

What I want to know is, under the "speed Aprox" on the ticket he wrote 75+ and under the CVC violation area he wrote the 22349 (a) exceeding maximum speed limit, paced at 85-94mph.

What is the ticket going to be for? 75mph?

I do not think that I went above 80 at all, but it's been a long night and I can't remember much right now. The officer was nice at least and said that I can just pay the fine through the mail.

He didn't pull up my past driving history, but I had a ticket back in June 07 for 95 in a 65 (which I fought and lost and was refused traffic school)

Will I be eligible for traffic school this time since I have never done traffic school before?

This is bull****.

dude that really blows, I've been awarded a 95 mph ticket myself so I know how that goes...I'm not sure about the being able to go to traffic school this time but good luck

Do you guys know if the amount on the ticket is based on what is written in the "speed approx" box? Because he wrote 75+ but like I said before, it says paced from 85-94

sucks to hear Kevin, sorry to hear you got caught. as far as your ticket goes i believe they go by the code.... and i think they charge differently per mile over the speed limit in other counties.
on a better note i was caught doing 105+ on the freeway. fought the ticket and got dismissed. cop never showed for my case. if you have legit evidence to show the judge then you can get your ticket lowered or dismissed. good luck man!

I'm not dealing with fighting another ticket this time. I had multiple defenses on my last one, it was water-tight and I still lost.

If you have to go to Walnut Creek Court, Goleb will always sign with the cops.

The code simply says exceeding 65mph,and in the written speed he wrote 75+ and in writting wrote that he paced me at 85-94mph

All I care about is hoping it's 75mph, getting traffic school online, and being done with this bull****, my parents are going to kill me. =(

i don't know how your county works bro. but i got caught doing 95 in sac. and my ticket came out to be 385 and the traffic skool cost me an extra 25 so i'm not sure but your looking anywhere from 275 to 375. sorry bro. i know it blows big time

Yeah, I feel ya. I was available for traffic school for my first offense, but since I fought the ticket, that was revoked. I'm hoping that I can take traffic school for this one.

good luck with your ticket. i have to worry about my own. i got caught going 50 in a 35 when the speed posted 45 just ended. only a hundred feet away from the 35 zone. that cop didn't even give me a chance to slow down... n-e wayz wish you luck!

welll he isnt allowed to pace you. he must use a speed gun. its in the code now where they cannot use their speedometer to give you a speeding ticket they must show proof with a speed gun. so this one might be worth the fight

having received tickets from the officer "pacing" me and having them recite in court the date of their car's last calibration, I would love to see this "new law" you speak of.

ngkghost, I feel your pain, I got nabbed once in MA for a speed I wasn't doing. He marked me as 50 in a 25 (suspendable in MA) when I was doing 30. Went to court and it was lowered to 30. A lot of times they say a big number to try to get you to admit to a smaller offense,

"No officer I was not doing 90, I was clearly doing 75!" GUILTY!!

sucks, but what can we do...


edit: fight it by mail in CA, its easier and if you loose you can still go to court.

exactly..... worst thing that can happen is you pay the fine which it sounds like your already willing to do. better off trying to fight it to save some money and who knows, cop might not even show. really its just your word vs his. he really has no proof.

The only reason why I don't think I'm willing to fight it is because 1.) I literally just got my restricted license lifted in 2/16/08 2.) I've been to that court house now 9 times because of the judge and how stupid he is. 3.) I watched other court cases when the defendant clearly was not doing what the officer said they were, and goleb (the commissioner) still sided with the officer.

As long as the officer can show that his speedometer is calibrated correctly he can still win. They are trained to judge distances/speeds/etc.

My thing is, it was illegal for him to be "pacing me at 85-95mph" without his sirens/lights on. So either I wasn't doing the speed he said I was, or he was doing an illegal act himself.
