Yeah, you got hosed. It's been my experience that everyone who involves themselves in the car world like we do gets screwed over atleast a couple times.
I've bought rebuilt rear diff members that had bad bearings for $700, had botched installs ruin hundreds of dollars in parts and still cost a few hundred more in labor, and I've been lied to about a parts condition before I bought it.
Hopefully he does the right thing and atleast gives you your money back for the trans. If he doesn't you're going to have to figure out some other way to get it out of him, because I don't know if the courts are going to help when it's a used part sold as is. You can't use lawyers in small claims court either, so your resources don't help you much there. Just don't do anything stupid like go looking for him with a bat or a brick for his car.
