Bummer.. Similar thing happened to me when i was 17 in washington. They decided to sue my insurance 3 years later. The case finally was settled last week. She got 50k... I am also 23 now. Dealing with insurance companys sux

C'mon... if you hit her at 40mph, you were in the process of braking... which means you were going faster than that... and STi's stop pretty damn well.

Any way you cut it, the driving was out of line. Glad you are ok though, and that she is ok.

I'm guessing car will be totalled?

I'm sorry man. Ironically, I was driving to school this morning and a yellow light hit one car in front of me just as we were about to hit the intersection, I looked up at the light thinking we would cruise through, then looked back down just in time to see that the idiot in front of me decided to slam on his brakes and stop for the light (I say idiot because braking for the light caused a dangerous situation... fool was on his cell phone).... It was of course raining like mad this morning, so when I braked, I knew my car would slide into him if I hit the pedal to the floor so just as I was about to hit this fool I decided to just dodge him and drove into the center divide, around him and through the intersection. I felt really stupid as a TON of people saw this, but at least I didn't wreck.

By the way: the speed limit was 45, and being that the guy in front of me decided to slam on his brakes at the very last second, I doubt I would have slowed below 40 before I hit him. The rain didn't help.

This situation happens a lot I think. Sorry about your bad luck.

lol I had that happen to me in my old 86 jetta several years ago. The roads were wet and I had the exact same scenario that you had (cept it was an old woman, no cell phone) and I slammed on my brakes (they were POS brakes too). I didn't have enough distance to keep from rear ending her, but I also became shocked and couldn't swerve to the next lane which had no cars. All I could do was slam on the brakes. Brakes locked up instantly, my car sliding straight for her bumper. I was like "Oh isht!" Miraculously, praise God, I ended up about 1 inch from her bumper I was so shocked the whole time I couldn't even pump the brakes (to keep it from locking).

Now, I'm just glad they installed countdown timers on those pedestrian signals so I know when to slow down or go through.

even if you slam the brakes, you might not beable to turn. glad that you are alright.
