First you should tell us what VC you were written up under.
Second, you should always fight everything, even if guilty, as that is your only right.
So was the pedestrian in a marked crosswalk, unmarked (intersection without lines - what it sounds like) or just crossing the street?
Technically the pedestrian can not waive the right of way in a crosswalk, marked or not.
They either cross or leave the crosswalk.
However, if the pedestrian and you are engaged in a visual dialog, no judge should find you guilty of not being aware or failing to "exercise due care" for the pedestrian.
