Seeking CA 22349-VC Advice

Hey guys. I was 680N and got pulled over for speeding earlier. CHP officer said he paced me at 80 and that's what he wrote on the ticket. Violation is 22349-VC infraction.

I got a ticket for 97 7 months ago and plead guilty. I was researching and people are recommending a trial by declaration. Someone said to file a motion for discovery and hope that they don't reply to dismiss all evidence. Also read that using the right to a speedy trial as another excuse for getting it thrown out.

If anyone could help me get this out of my hair and not get it on my record I'll be happy to pay you for your troubles. I was hoping for step by step advice and maybe a TBD letter format

I have used the Motion of Discovery route in the past. File for every inane little detail you can think of. Officers DL, training records, vehicle records, Tire data(age), speedometer calibration, license of calibration tech, test records of calibration tool. If you can think of it, ask for it, even things like ticket and arrest records. Somewhere in that list of things, they will mess up by a)not getting it to you or b)have a wrong date/time/number. That is all it takes, you can now "no longer defend yourself adequately" and so "in the interests of justice, the case will be dismissed"


Oh...and SLOW THE **** DOWN. Just go with the flow of traffic, don't get out in front, don't be the guy passing others.

Did you do a trial by declaration? When did you file a motion for discovery after you got cited?

I read somewhere where someone suggested you file it on the day of the first court appearance, plead not guilty, and request a TBD. Then within 15 days if they don't Mail any information you can use that as your defense when you send in your TBD?

Haha this is awesome!

Will have to use this if i ever get a speeding ticket hopefully never

Speeding tax - if you're going to speed, accept the consequences when you get caught. Not sure why people fight blatant speeding tickets, especially here when you have established a pattern of speeding (not that I don't...). I just got one a few weeks ago too, first one in years. You pay it, go to traffic school and move on.

This! While getting it dismissed would be nice, I figure it's just a tax for those that like to go a bit faster than the posted speed limits. Those that are "smarter than the average bear" avoid most of these taxes because they're (1) paying attention (and either see the CHP officer before he sees them or knows the places the CHP likes to hide), and/or (2) using a radar detector. I figure one ticket every 2, 3, or 4 years is simply the tax for getting everywhere a bit quicker

The only time I've seen a traffic ticket for speeding thrown out is when the driver hires an attorney. Judge always just tosses it.
Trial by declaration...never lost one. Soooo much easier than going to court.
And depending on the judge, if you start asking questions like vehicle speedo calibration and all that, 9'times out of ten the judge will interrupt you and find you guilty.

Hire one of those traffic lawyers. You will pay the fine in their fees but you won't get the hit on your record or insurance...
