man i dunno but i would have just returned the damn money...
i doubt you cancelled the insurance that day, even so if it was in your shop it should have been covered... it sounds like the sustained major damage and im sure you shop did to so your shop insurance should have covered the damn car. Regardless who the owner was
put yourself in his shoes mark... you guys know the story way beter then anyone here and you know whats right.

Nobody came out on top..its one of those things where you have to cut your loses...In my case 2k..don't act like your a poor kid either.. (not like that has much to do with this, but you are trying to play that card)

If I had to make a "ruling" on this, I would split it down the middle and here is why:
If Mark did not sell the car, he would have gotten $1700 for it.
If the buyers claimed it on the insurance, they would have gotten $1700 for it.
So, seems right. And, since Mark paid $2,000 back to you guys, I think that is fair. Why should he take the full hit on this. After all, the sale was complete. The car no longer belonged to Mark and it was yours to pick up. If he promised to deliver the car to you, that was a favour. Not an obligation unless otherwise mentioned on the bill of sale. It is not his fault that it rained. If the car was still under his name and insured, he would have gotten $1700 for it. Instead, he took $1500 and refunded $2000.
So while this story totally sucks and I feel bad for both parties, it is the fault of mother nature and a number of bad coincedences and circumstances.
Once again, I am not taking sides, just speaking my mind after reading the info provided. Facts that both of you concurred with.
Oh yeah, what kind of car was it anyways?
