guess you never heard of "probable cause"?

what about the 4th amendment? 5th amendment?????

anyone? bueller?

granted, a cop CAN look under you hood without a reason, but if any evidence is gathered through that ILLEGAL search, then you have a way out.

that's why i said, if a cop stops for ANOTHER violation, he/she can then ask you to pop your hood.

the first thing out of your mouth should be, "NO thank you officer. may i go now?"

another situation. you and a friend are talking on a parking lot. a cop passes you. he leaves. you are about to pop your hood to show you friend your engine. cop comes back and asked if he can see what under you hood. he heard that street racers likes to congregate at the local krispy kreme on tuesday nights.

at this point, you tell the cop in a nice way, "unless you have scientific proof that you have are a mind reader, i politely ask you to GO POUND SAND..."

At which point you've just bought yourself an impounded car, regardless of the legality.

What are these "amendments" that you speak of ? you must be thinking in a pre-911 mode, get with the program!

You have no rights, your freedom is at the whim of the authorities, so be good or go to jail.

A cop cannot "Legally" pop open your hood unless they get permission from you. There has to be reasonable probable cause. (IE: Excessive speeding, very loud exhaust, driving like an ***, etc) Think of it as a search warrant, without one of those, cops can't just force themselves into your house and do a search. If they do, its illegal. Samething with the car situation, if your driving normally like everyone else and they pull you over and ask you to pop the hood, you can legally say no. If the cop is being an ***, ask for the supervisor to come. Simple as that.

if the cop see you have an exhaust on your car. he may assume that you have more modification under the hood, and that gives him the reasonable suspicion to pop your hood. when he pull you over his eyes is looking all over the place in side your car. looking for anything that might look like you are a racer. such as side pod gauges, turbo timer, or any those electronics. if you car is lowered, and have wheels, is all part of suspicion.

i do what the cop ask me UNLESS my car is stock. if you car is stock then you have nothing to worry about. even you have an exhaust that is under what ever dbs which is legal, cop can still write you a ticket, and you go get it tested to show that your exhaust is under 92 dbs or something like that. so no point of arguing with cops.

if you tell him NO you cant pop my hood, some time could just cause more trouble.

have you try telling the cop NO you cant pop my hood, now go byebye. cops would not let you go that easy if you said that to him.

Lol, that's pretty much what my first thought about his statement was..

Back in 04' when I had my 04' Mini Cooper S it was heavily modded but from under the hood it still looked stock thanks to Randy Webb of Webb Motorsports. I used to hang out with a buncha guys who had SRT 4's and we were at a meet somewhere in SSJ. A cop rolled in, then a second cop rolled in and asked for everyone to pop their hoods. My hood was already popped due to the fact I was showing it to someone. Everyone else basically told the officers to go "pound sand". So, I was told my car was legit then they left. About 20 or so minutes later, the cops came back and blocked everyone in and 3 minutes later 19 tow trucks came in.. Hence, you can figure out what happened. I was the only one not impounded that night.

So, yea, you guys can all politely tell the cops to politely go "pound sand". Basically, at that point you're telling the cop to f*** off, well there are consequences..

You own an STI, get used to being pulled over..

Huh?! SJ CHP have proven themselves to be quite the pain in the ***, but for every SJ story, I've heard 10 from SoCal.
