regardless of whether or the kids death was justifiable, he was killed by someone who was defending himself while being held at knife point and had his life threatened.

it would be more unjust to charge the victim who was only defending himself...

CA has a felony-murder rule. If, during the commission of any felony, ANYONE dies (even one of the criminals) for basically whatever reason (even being killed by the victim), all those committing said felony can be charged with murder. Hopefully the other douche will die in prison.

IMO, one of the great things kalif ever came up with...

too bad it aint used enough.

just to clear up some things here:


1. the true VICTIM feared for his life. in kalifornia, there is a pseudo CASTLE LAW. it means you can use any and all means to protect yourself from death or loss of limbs. and that means including DEADLY FORCE.

now, the trick is once the threat is gone, your use of any and all means, is also gone. for example, if someone breaks into your home and you scare them away with your firearm, once the robbers flee your home, you cannot shoot them in the back as they are running away.

also, another tidbit in kalifornia law books, it also specifies that you must do everything in your powers, to leave the threat. including abandoning your home when you have a chance to prevent being physically threatened. hence the PSEUDO CASTLE LAW, unlike what other states are passing.


2. license to carry a concealed firearm. CCW... the biggest crapshoot in kalifornia. the rule is that local law enforcement agency where you live is supposed to issue these.

but like in alameda county, most local police depts have given this duty to the county sheriffs office. and in alameda county, one way to get one is to publicly have your life threatened in the tv news and local press. as in the example of the oakland man who shot a local hoodlum in front of his house when he was threatened. he refused to move out. eventually, oakland PD was FORCED to issue one to him... kinda sad.

and as earlier pointed out, the location of where you live can give you an advantage in getting one. take a look at tehama county:

while this link is now buried 3 levels deep in the tehama county sheriffs office official website, a few years ago, this link was second from the top from MAIN PAGE.

it's nice to see a sheriff with such vision. i actually emailed him and thank him for his stance, and i joked, "is blood running through your county's street with all the gun violence from this?" he replied no.


finally, in the end, i believe the TRUE VICTIM did everything he could once his threat level escalated to that point. he saw that it was either his life or theirs.

in this case, the good guy won. and the true BAD guys lost.

kinda late but....
i guess when people say "he got what he deserved" they mean of the 3 parties involved, if one had to get hurt or die, the right person did. just my .02.

In a word.. Yes.
This man threatened another mans life, attempted to take his livelihood, and stole his liberty (if only for moment before the man stabbed him)

He deserved what he got. Society is better for loss, even if it only prevented one such crime. If we're really lucky it deterred one other person from attempting to rob someone else.

Call it cruel, heartless, whatever..

In my opinion, Gonzalez and Veliz should not have attempted to commit robbery. Had they not done that, no one would be dead right now. They seem young, 18 years old so this might not seem all that serious to them at the time. But of course, this is very serious. The way I see it is that if Gonzalez was threatening to shoot me with a gun and his friend Veliz was holding a knife to my throat, I am going to use self defense. This is a difference between life and death for me, so why am I going to just surrender myself to them and let them get away, thinking that it's okay to do this sort of thing, and go off robbing someone else or, even worse, hurting someone else just for kicks.

I believe the victim only used self defense and I hope that he will come out okay in all of this. I think the victim's gone through enough.
1) having 2 guys threaten you and having a knife held to you
2) having to deal with the fear of not feeling safe everywhere you go
3) being held responsible for a death and having the fear of getting charged
4) a father trying to make you pay up all because of what their irresponsible son did to them

It seems as if people just do whatever they feel like nowadays. It doesn't seem to phase people that in life, if you do something wrong, you will get your just desserts. You can either agree to agree or agree to disagree. Either way, it's just an opinion.

When all of you guys say "well, they'll get what's coming to them" nuhhhh uh. I hate when people play the "safe mode" and say "well what was done to me will be done to them twice as bad" and in actuality they don't do anything themselves. 18 year old might be young, but he has a conscience. If you **** with a snake and you get bit, that's your own fault.

The guy deserved to die (you threaten someone's life for... no apparent reason? Money perhaps? Then you deserve to die.). My friend got a screwdriver to the back of his head, 18staples, cuz he was robbed by 3 mexicans behind Union Landing near the Gas Station next to In and Out, and for what? 10 bux in his wallet?

If wanksters want to mess with people, they are risking their life everytime, this time it bit them in the ***. I hope he suffered every drop from being stabbed to getting into his house.

being a robbery victim myself, i was held up with a knife to my chest at an atm on jackson... fck that kid, somebody should probably take out his dad too for raising such a POS.... side note, the guys who jacked me walked away, i stayed, called the cops, they wanted me to go to police station to file the report.. instead of sending a car to me.... yes, i still get pissed about it
