i plan to fight the unsafe lane change, that was total bs. i dont plan on fighting the smog, i plan on putting the stock stuff back on and taking it to the referee. hopefully it all goes well

actually.. there was some discussion I read about before where the debate was if the exhaust gives PC due to the fact that a cat-back exhaust is not illegal in the state.
thats like looking and seeing a briefcase in a car, and then searching the car for drugs cause the briefcase *could* carry illegal items
just because a car has an aftermarket exhaust, there is no reasoning that it *has* to have other illegal parts on it

BUT...you can't use the "briefcase in the car" as a good example...because the exhaust was direct proof that you have a modification leading the officer to believe you could have more extensive modifications...in a sense it would be like you rolling down your window, and the cop smelling marijuana smoke...doesn't mean that you have drugs in your car, but its enough pc to make an entire search for drugs in your car legal.

yeah usually state referee is a licensed smog tech or a licensed inspection station. oh yeah one more thing, ultimately it depends on the judge whether or not the officer's reasons for probable cause were legit. what i previously said about the exhaust leading the officer to believe you have more extensive mods has some error in it, my pops just got home, he's a retired cop of 20 some odd years, he said for what you were pulled over for and since your exhaust is state legal (assuming its emission legal) the cop may or may not have had a legit reason to search under your hood...then he said something about being in the gray area in that matter and that he'd never search under anyones hood for any reason unless a drug dog sniffed out some drugs in there lol.

this is why the state needs to come out with very tight specifications for road-side emmissions inspections like that
but I guess thats what we get for living in a great state like we do :P

I've seen people get away with the following:
-IHI turbo, similar to stock
-JDM/Catless UP (lookes like it has one)
-Ecutek reflash
So, just return it all to stock... only way to be 100% sure. failing and being classified as a gross poluter is not good at all. mucho money in fines!
