Angry man i got a ticket!!

i got a freakin ticket for unsafe lane change, what bs, in pretty much no traffic too. then when i pulled over the dike on the bike was all looking at my car, looked at my engine (wouldn't of let her but from the engine point of view looks stock) then she looked under my car and gave me a ticket for 27156(a)(b) modified smog, and now i have to get it cleared by the state. she also took some kind of picture of what she could under my car.

does anyone know why she took the pictures?? im guess i gotta put back the dp and the up if my friend cant clear that part of the ticket, and get it cleared.

Unsafe lane change is BS.
If it were unsafe, then how come nothing bad happened when you did it?
You can fight that part for sure.

As to the exhaust and referee, lame.
That is the Gross Polluter violation.
Back to stock for you.
i don't know what the picture is about.
Maybe she wanted to show her boyfriend what a cool exhaust you have.
Hopefully, it isn't for evidence of modification.

So are you stock from the downpipe back?
If so what the hell was she looking at?
You can't see the downpipe from under the car very well.
Do you have a fatty muffler?
Be funny if you got that certified ok.

yea i got a dp and an up, i gotta put all that crap back on and go to the place to get it checked out. yea i plan on challenging the unsafe lane change. is the modified smog just like a fix it ticket? she wrote on the thing it had to be cleared by the state. when they took the pic, she called another police officer to bring it, looked like some kind of high tec polaroid?

do u have to replace the uppipe?? i though just putting on the old DP would be sufficent?

Did the picture have grid lines on it?
That is what an evidence polaroid looks like.

Yeah, you go to the State referee Stock and they check out the car and say Ok. Sign that you have brought the car back into compliance and you are all good.
When you get a copy of the ticket (assuming your address is correct) youmay get an option to pay a fine without complying, so you might be able to do that too.

Maybe the pict is just to show other officers what a modified exhaust looks like?

If you let her under the the hood, she could see the downpipe probably.

It sounds like they are really cracking down on modified exhausts.

nah i was watching her, she didnt really get that far back to see, plus i still have to turbo heatshield on which blocks even more. i didnt get to look at the pictures itself, i just saw them foolling around with the camera, and her partner said they were taking pics. at one time they had 3 cops there

has anyone else here ever gotten a modified smog ticket?

maybe for smog, but i have to take it to the ca. referee place, they check everything. i plan on leaving my hks catback on though, since its not illegal and doesnt hurt smog. and i plan to leave on my ic hoses. everything else goes back. i'll probably turn down my boost also.

Ah. Prolly the HKS catback that got her attention.
And she didn't write you up for noise so you are good there.
Although while youa re at the referee you could ask for a noise certificate of compliance too just to have.
Assuming that exhaust will pass.

Several other folks have gotten modified exhaust tickets.

yea at first i thought it was just a modified exhaust, but the ticket says modified smog, hopefully i dont get fined or nothign as long as the referee station clears it. im just curious about that picture, like when i bring it in, will they use the picture to compare.

Even if they do it shouldn't matter since the whole point it to bring the car back into compliance.
Do you think they actually got a pict of the downpipe connection?

i was looking under the car, and yea they couldve gotten a picture of the bottom part of the dp where the midpipe would be. since my dp is all one piece, i have to take it off and put the stock downpipe and midpipe on.

here is what the california vehicle code says...
what city was this in by the way? and was it chp or a city cop?


27156. __(a) No person shall operate or leave standing upon any highway any motor vehicle which is a gross polluter, as defined in Section 39032.5 of the Health and Safety Code.

(b) No person shall operate or leave standing upon any highway any motor vehicle which is required to be equipped with a motor vehicle pollution control device under Part 5 (commencing with Section 43000) of Division 26 of the Health and Safety Code or any other certified motor vehicle pollution control device required by any other state law or any rule or regulation adopted pursuant to that law, or required to be equipped with a motor vehicle pollution control device pursuant to the National Emission Standards Act (42 U.S.C. Secs. 1857f-1 to 1857f-7, inclusive) and the standards and regulations adopted pursuant to that federal act, unless the motor vehicle is equipped with the required motor vehicle pollution control device which is correctly installed and in operating condition. No person shall disconnect, modify, or alter any such required device.

(c) No person shall install, sell, offer for sale, or advertise any device, apparatus, or mechanism intended for use with, or as a part of, any required motor vehicle pollution control device or system which alters or modifies the original design or performance of any such motor vehicle pollution control device or system.

(d) If the court finds that a person has willfully violated this section, the court shall impose the maximum fine that may be imposed in the case, and no part of the fine may be suspended.

(e) "Willfully," as used in this section, has the same meaning as the meaning of that word prescribed in Section 7 of the Penal Code.

(f) No person shall operate a vehicle after notice by a traffic officer that the vehicle is not equipped with the required certified motor vehicle pollution control device correctly installed in operating condition, except as may be necessary to return the vehicle to the residence or place of business of the owner or driver or to a garage, until the vehicle has been properly equipped with such a device.

(g) The notice to appear issued or complaint filed for a violation of this section shall require that the person to whom the notice to appear is issued or against whom the complaint is filed produce proof of correction pursuant to Section 40150 or proof of exemption pursuant to Section 4000.1 or 4000.2

(h) This section shall not apply to an alteration, modification, or modifying device, apparatus, or mechanism found by resolution of the State Air Resources Board to do either of the following:

(1) Not to reduce the effectiveness of any required motor vehicle pollution control device.

(2) To result in emissions from any such modified or altered vehicle which are at levels which comply with existing state or federal standards for that model year of the vehicle being modified or converted.

(i) This section applies to motor vehicles of the United States or its agencies, to the extent authorized by federal law.

shoulda refused the searched and then have them wait and bring in a search warrant.
