So, this is first accident i have ever caused - and it makes me like a retard - and if it werent for the absolutley outrageous behavoir of the moron i hit, then i wouldn't have even posted this. Anyways, here's the scoop.

I had just picked my girlfriend up from the ashby bart station, and we were heading down ashby, when, during the intersection traffic abrupty stopped. I caught it in time, but when i eased off the brake me and my girlfriend were disracted by one of the most rediculously dressed hooker i'd ever seen. What i didnt realize is that i was still rolling forward at a few miles per hour. WHAM! I bump into the back of a mid nineties model black mercedes. We both pull over on the corner of san pablo and ashby - and i get out to survey the damage, expecting my bumper to be all mangled and his mercedes to be destroyed.

My from bumper showed no sign of even touching anything while is rear bumper was pushed in a bit. Cool, no big deal, i have good insurance. As i walk towards his car an older chinese guy gets out and i ask him if he is ok.
He's holding his back and neck and is shaking his head. "OH MY BACK!" Now, keep in mind he is holding the middle of his back and the front of his neck. "Oh, you hurt your back eh?" I say with a heavy heavy tone of sarcasm. "Yes and i am dizzy" he says. This is when i get mad "oh yeah, that was a pretty intense wreck, wasn't it, damn near vehicular manslaughter" i say with an unhappy smile. "yes, my back is very hurt" he says.

Some cops that were standing on the corner come over and we chat about the accident, and its pretty obvious that they know whats going on - as they were super cool to us, and delightfully condescending to the idiot who now has to lay down on the grass because his body is so broken. At this point the cop asks him if he thinks he needs an ambulance and he says yes, but not without doing the math in his head first. So, much to the halaritude of the story, an ambulance and firetruck shows up, and the medics come rushing out ready for action. When the one lady medic comes to look at the damage done to our cars, she stops running, looks back at us and rolls her eyes. After checking the moron out, the medic comes back to us and asks us how fast we were going. "No more than 2 or 3 miles an hour" i say and point to my car " there's not even a scuff on my car". He laughs and tells us that if anyone asks, he checked us out and we were fine.

Now, while we are all standing around, cops, EMTS, firemen, - a black guy on a bike walks up and says in that halarious drunk old black guy voice "yo man! i fell off my bike, I'M BLEEDIN!", and the cops try as hard as they can to stifle laughter, as he had a bottle of booze in the bottle holder on his bike - then he proceeds to try and light a cigar while the plastic wrap was still on. Anyways, all in all - This guy is suing me, but if all works out, they will see the damage done to both cars, and it will come out that i dont have to sell my car.

Either way, I wanted to punch this idiot in the face. Literally, like, body slam the sonofa*****. Break him like a twig, but, i kept my cool and the cops respected that. However, i have never seen such a halarious attempt at gold digging in my life. I hope you all never have to deal with that.

Sorry to hear about the accident. That totally sucks. Sounds like something my greedy *** uncles would do. Unfortunately, your ins will prolly just pay him off and raise your rates just to avoid any legal costs. Maybe you should have lied before the cops got there and said you didn't have any ins. He prolly woulda instantly got better.

 

my mom backed into a car once and the dood comes running out all crazy. Swapped insurance, adjuster came to look at both cars. No damage on my moms car. Claim didn't go through.

 

If you have good insurance, your policy should cover you in the event that he attempts to sue you. Regardless, it's likely that the court would find in your favor. My gf got sued a couple years ago by some stupid *****. She sued for like $5,000 and the accident was similar to what you described (though she was not paying attention for reasons other than a hooker I'd imagine ). We went to court, AAA hired a lawyer to draft a briefing on our behalf. He sent it to the judge (since lawyers can't defend you in person in small claims or something like that) and the judge read it and had pretty much decided before we even got there. The chick lost and got stiffed with $5,000 or so in un-needed medical bills hahah

 

my girlfriend just got into that same accident, and she told me just now that no one can claim bakc injury unless there is significant amount of damage to both cars. so your in the clear. just remember to always stress there was very minimal damage.

 

oh by the way she actually just got into a accident on that same street

 

Make sure you get a copy of the police report, EMT report, and get your insurance company to find out if he has any previous medical problems/injuries related to his back/neck and you should be all good man.

 

Haha. But how do you know the guy was Chinese? Was he speaking Cantonese or something?

No, he was speaking cantonese or mandarin on the phone. I know that weird phonetic drawl anywhere, especially after having my landlord scream it at me for no reason everyday.

 

That sucks dude. But sounds like you have no problems. I bet the insurance comp. will drop him $5k just to drop the issue. You'd be surprised what they do to avoid a lawsuit.

my parents' van got plowed over by a ford going 70mph while we were almost completely stop. i had back pain for months and i still didn't want to sue the other party cuz i figured i've pretty much recovered. it is scum bags like this guy that makes driving so expensive.
