a fire fighter kicked my car
maybe you should have stopped, but no where in any book does it say that they have the right to kick your car just because you didn't stop. if you deserved a ticket then so be it...but i would have at least tried to get the guy to pay for the damages done to my car. yeah they're trying to save people's lives...but i would have gotten a small bit of information...name...badge...whatever...so i can get it settled later. and i wouldnt have worried about my driving record so much...still no excuse to damage somene else's property
his fault - kicking your door
your fault - not getting out and asking why he kicked it
I mean you were probably like "WTF" and in a hurry to get somewhere so you couldn't stop, but yeah for these kinds of things you really need to get info at the scene or you are pretty much SOL

no i didnt feel it would be right to stop and cause a bunch of dramam while they are trying to save someones life
and for the other comment about the road being clear the accident was clearly on the right shoulder in the bushes and the road infront of me was completly clear of any debris or anything

Obviously he wasnt busy saving anybody's life if he was there directing traffic.
If someone smashed the door of my baby, there would be all kinds of drama
My question is why you didn't get out to question the firefighter, i would imagine he was still standing there after he kicked your car so you could've identified him and done what was necessary.

If a firefighter tells you to stop, you stop. If he signaled the ambulance in, them you should have stopped until the road was cleared by the emergency personnel. I do know that you you block a firetruck or hydrant, the firefighters have every right to move your car with what ever means necessary. Even if he did kick your car, you were at fault for not yielding. I know for a fact, that if you go around a firetruck without being waved by, is an arrestable action. I've done it once when my driveway was blocked due to an accident across the street from my house. The trucks were blocking the north driveway so I went around to the south driveway and was met by a CHP and a fire captain who wanted me arrested for going around. Unless you are being waived by, don't go around emergency vehicles.

so what you are saying is the law can pretty much f%^& you and your property. WOW i thought that only happened in India where the police first start beating you and destroying your property. Then they ask questions.
Where is the world going :jay:

I think the firefighter over reacted and he should have paid for the damages.

Sounds like you're lucky the police weren't there to write you a ticket for failure to follow instruction of emergency personnel. If a firefighter at the scene of an accident is waving his arms at you, do you really think it's up to you to decide if it's safe to proceed? You were being an idiot.
you call me a idiot and you were not even there.
thanks thanks alot

he saw me sitting behind the ambulance he could have signaled me to stay put, but he didn't so i wanted to make way for more emergency vehicles and my lane was completly clear in front of me so i proceeded.
I'm not a ignorant driver i know the laws and he was wrong
but if i would have waited around to settle the issue i would have been late to work and that cost more then the $100 to remove the damn dent.
I went by the firehouse tonight to talk this over with the fire chief and guess what he knows nothing about it and none of his guys will admit to doing it. so case closed..

if he would have raised his hand like a normal person with his palm open and have been facing me i would have stopped

it probly pissed off the firefighter when you DID proceed while he wasnt facing you...then he realized you started to go when he wasnt prepared for it...its all eye contact i think.
CHP officers get killed along with caltrans workers...being next to the road can be safe if youre aware, but it only takes one time.
