he shouldn't have to pay the deductable because it wasn't his fault. The other guy's insurance should pay for it. If any money comes out of your pocket, then you need to switch insurance companies.

I thought a hit and run is in the clear with your insurance company, IE: you are penalized for a hit a run.

I just talked to my insurance company this morning and I filed the claim on what had happend to my car. My insurance had told me I have to pay nothing out of my pocket and and I will be taking my car on the 31st of this month to "The Works Auto body" in Santa Clara. I talked to Chris the owner and he was very nice and helpful and I asked what would be better to restore the fender or just add a new one, he told me just to replace it with a new fender and repaint it. It's going to take at least 2 to 3 days for them to finish. I did check out my car and nothing else is damaged except the front fender. I guess I am very lucky the person who hit my car did leave a note and nothing major damage to my suby. Oh by teh way it a was a sanition truck that hit my car, due to many porte potties on the truck he couldn't see my car. Can't wait for my car to get done!

remember, most insurance companies let you go to any body shop you want, however insurance won't warranty the work done from the shop unless it's on their recommendation list. If you want to go to your own body shop, you can get a check from insurance (for the amount they think it will cost) and take it to any shop you want.

Just as a general note. Some insurance companies will waive your deductible if you aren't at fault and they have ID on the responsible party, those companies usually don't keep that policy for long. Most will still make you pay it up front and will then attempt to recover it from the other carrier and reimburse it back to you. If the other party isn't IDed then I don't know any companies that will waive the ded.

The company I work for doesn't waive deductibles under any circumstance (except one very rare one), we charge it up front and get it reimbursed or ask for the other carrier to advance it. No ID of the other party? No ded waiver.
