they don't, just like they don't bust you for loud exhaust or illegal engine modification, they send you to someone who DOES have the proper equipment/knowledge (ie the state ref). You're not busted until the ref busts you. Now, I believe recent legislation has changed this somewhat in that it is now at the officers discretion as to whether or not exhaust is too loud, etc. but for the most part, they don't have the eqiupment while in the field necessary to test certain things like that so they send you to the ref
