I'm not sure what the limit is now but since he wrote you down 36 over the limit, it's mandatory to show up for court in that county. I know it sucks but it wasn't so bad for me. I got written up once at Bakersfield 95+ at 55. 40 over... I thought I was dead meat. I showed up, pleaded "NO CONTEST", got fined for $190 and I was on my way.

If you have legitimate reasons and he doesn't have proof on the radar gun then you should at least have the fine reduced if not thrown. I'm not too sure about how strict the letter of the law is.

I learned about Aristotle in Philosophy class. How his way of thinking was whatever the rules are have to be followed. Thoreau on the other hand said something like this: If some guy was chasing you in a car with a gun and was threatening your life and you ran a stop sign to save your life, is it just? Would you get a ticket if some cop saw you?

Although that is the extreme case, you were just saving your car from further damages. So ask the judge if he would have done the same. Ask him if he'd sit behind a big rig going 20 mph under the speed limit and have debris land all over your car. Convince him you were only doing the logical thing. =)

BTW, just b/c u went to traffics school within 18 months, doesn't really mean u can't go again. You can ask the judge for traffic school... if he doesn't ask you if you've attended within 18 months, you're set, if he does, you still have a chance of him awarding it to you. I've had this happen several times

I was going to say the exact same thing. In fact, I just came back from traffic school and even the instructor said as long as they grant you traffic school (even within the 18 mo period) TAKE IT.

I was driving on 880 s this weekend (going the speedlimit) and a very long big-rig started shifting into me (I was in the far right lane)... i took part of the shoulder and brought it up to 90.... The truck is the diagonal. You are the vertical bar. You're both driving towards the top of the computer screen, although the truck is veering right, into your lane.

Instead of trying to speed up and get around the nose of the truck which is closer to you, why not just get on the break and let the rear, which is further from you, pass you buy? Was this not possible for some reason?
