DFW area - yearly emissions check vs exhaust mods

Bought my first WRX (2002 sedan) last month and now my first post. This car is my daily driver so I'm more concerned about reliability and streetability than raw performance. Eventually I'd like to get around 250whp.
I live in Fort Worth and I want to do the typical cat-less up-pipe and TBE but am concerned about passing the yearly TX inspection/emissions. If I keep just the stock down-pipe and cat will I pass inspection? I read on the TX DPS site that on newer cars they just check the OBDII to see if there are any emissions equipment problems. Does that mean they don't actually measure the exhaust emissions (sniffer test)?
On a related note. My car is bone stock so will I see much difference by gutting up-pipe and removing the third cat but keeping the stock down-pipe with cat? Or do I need to loose the DP cat too?

Joe, if you have the budget you can always buy a hi-clow catted downpipe. I believe Helix and Cobb Tuning makes them. Thay are a a bit pricy, but from what I hear they work extremely well. On another note, you will get the most performance out of gutting the uppipe and removing all the cats. You can keep one in the downpipe if you like, but IMHO I think its useless and might as well just go catless. As for emissions tests, there are plenty of places in Houston that will pass you if you pay them a little extra $$. Or if you get lucky, you can find the ones that are desperate and will pass you regardless. Also if you would like, I have an uppipe that I can sell you. I already sent you a PM via NASIOC.
