High court strikes down gun ban!

Link to Ruling

It's about time that The Supreme Court ruled on this issue.

WASHINGTON (CNN) -- The U.S. Supreme Court ruled Thursday that a sweeping ban on handguns in the nation's capital violated the Second Amendment right to bear arms...

...At issue in District of Columbia v. Heller was whether Washington's ban violated the right to "keep and bear arms" by preventing individuals -- as opposed to state militias -- from having guns in their homes.

I thought the right to bear arms was in the constitution.

The 2nd has not been addressed since late in the 1700's. Until now it was interpreted by some to read that only organized militia had this right. Because of this some places like the District of Columbia (D.C.) had the authority to regulate who could posses certain types of firearms. Making handguns illegal in the district of columbia, or possibly anywhere else.
The high courts ruling makes it legal for a citizen who is not member of an organized militia to be protected under the second.
What's really troubling about this is that it was a 5 to 4 in favor of the second. We were one vote away of losing the 2nd. Something that you and I consider to be protected could have easily been stripped. Even more troubling are the pinkos opposed to this ruling finally showing their true faces. Sheading light on an issue which had obviously created a lobby to kill the second amendment. The fascists have no respect for the Constitution and your rights that it protects.

I wish they would have answered the incorporation question.. But I guess that will come soon enough.

I think the ruling was a little too weak..

I believe there was one supreme court case in the 20th but nothing to this extent. This ruling is arguably on the same level as legal abortion.

I totally agree with you on the 5 to 4 ruling and was talking to my attorney friend/gun owner last night on the issue. How crazy would that have been. One of his theories was that because there are a lot of low-level cases on the 2nd Amendment that go against the people, the 4 Justices may have quietly referenced those for their ruling. Idiots if that's the case and defeating the purpose of their position.
