Yep, Clarence Thomas is the supposed front-runner for the chair of the Chief Justice!

So is this some sort of racist remark or what? I watched much of the CT hearings and I think he holds up under the microscope.

The more authority the court has to strike down legislation, the LESS democratic our country is. You realize that right?

That is absolutely true. Has Clarence Thomas been accused of legislating from the bench? I was under the impression that he takes a conservative approach.

I realize that Clarence Thomas in the highest judicial position in the United States is a complete travesty.

He does. You'll not find people accusing Clarence Thomas of legislating; what people sometimes accuse him of is using strict textualism to promote conservative ideals.

His decisions, roughly, go like this:

Federal Legislation: If it's not specifically allowed by the Constitution, strike it down.

State Legislation: If it's not specifically prohibited by the Constitution, it's allowed.

Individual rights: Gray area. Have to be somewhat related to the rights in the text, and are limited by broad powers of state governments to legislate.

Yeah, except you got that wrong: Thomas is one of the justices who like Scalia scoffs at the "penumbral" approach that the Griswold case started up.

See above for how Thomas tends to rule on cases.

Because it is a character issue, not a race issue!! Now, if only black men had pubes then perhaps it would be a race issue.
