Felony Murder is qualified as a Malice which is need for Murder

Felony Murder= a homocide commissioned in an inherently dangerous felony is murder..

now... does that particular case qualify for an inherently dangerous felony??

Never heard about the case until now. The only ones I heard about were the Corvette and the Lambo that crashed in NY and the guy from Florida driving the Mustang who hit and killed his own mother. From the article the judge is allowing the charge because they should have known it was inherently dangerous. It also very likely didn't help their case that at the hearing the guys own friends said that they had been trying to convince them to stop racing because it was dangerous. In all likelyhood the case will end up being pleaded down to manslaughter and them agreeing to dothe maximum time rather then risk 30 to life like the article says they are facing.

Uh, I don't think so. The law recognizes degrees of negligence in your behavior and no sane judge is going to hold you responsible because a cop killed himself trying to catch you and ticket you for a simple moving violation. Unfortunately, it seems there's a few nutwhacks on the bench these days, so you never know. Hooray for "bingo justice."

As for the case that started this thread, I bet the D.A. pressing for the 2nd degree murder charge is ultimately after a manslaughter conviction. It's common practice for a D.A. to go for a maximum charge that stretches the boundries of the statutes in the hope that a more reasonable charge is more likely to stick. Given how unpredictable the law has become, I can't really say I blame them. I hope these a-holes spend a solid chunk of their lives in prison.

I just had to add another thing to this thead...
Coming home I found the supra that lives near me had broadsided a wagon with a parent and two kids in it..... on the intersection by my house.
I saw the two children by the ambulance but the father.. well I think it was their father... I could not tell I was too far away... Supposedly the supra ran the red and hit him. I could tell it was the supra that always is street racing because he is the only one who has the veilside kit in my city.. I am not sure but I think the driver was dead... they had to cut apart the whole car to get to him.. two teams with jaws of life working.. taking 7 minutes is not good. Seeing something like that and knowing it probably had something to do with street racing makes me sick to my stomach..... The driver of the supra did not mean to... but those kids probably lost their dad tonight. I can see how they would justify the charge on these other people that we are talking about in this thread. If the person in the car dies it will be the first death related to racing where I live... It is not on the news yet so I dunno if he is alright or not..

And because if street racing they want to form laws outlawing any performance part.... I MEAN ANY.... a k&n intake could be considered illegal punishable by being arrested and having your car towed and having to pay to have the part removed..
I doubt they will pass but it is because of people street racing on public roads that I now have to deal with crap like that.
