Well... First I wanted to say hello...
New owner of a 2014 sti sedan ssm

Saved up for about a year and a half for this car and some idiot decided to rear end me.

The car had $10,000 in damages and I still don't have the car back. I've had it for 2 weeks and now in the shop for 4 lol. No frame damage tho. Whew.




So the question I had was can I pursue diminished value. Has anyone been Able to win this case in small claims???

I'm seeing a chiro as well. 3 times a week for minimum 8 week.... My neck and lower back hurt bad. She hit me when I was dead stopped.
Grabbed an attorney immediately.

 

Have no experience in this field but sad to see such a beautiful car like that and hope you heal fully soon!

 

I'm going through the same thing. Based on my reading Diminished Value doesn't seem to work in California.

I read that Farmers Insurance took took this to the Circuit Court of Appeals and won, I. California.

Of course, I'd like to be proven wrong because I absolutely believe I should be compensated for the diminished value of my vehicle.

 

I'm going to keep researching. I hope someone else with experience chimes in. Any lawyers in here.
