Yes, but it is kinda bull**** to have to send it back to the factory in order to replace it. Also, they should report all important information such as this inside the owners manual as well as on their website.

That was a quote from the link he posted. I didn't write that. 
It was the same way with the ipods. Nobody's forcing people to buy these phones.
80% at 400 cycles. Assuming you recharge once every 2 days, that's 800 days = 2 years and 2 months roughly... by that time, there will be much newer, better phones to choose from.
I just don't think it's worth a lawsuit.
