I don't think something mechanical will fix the boost creep, sound's like some sort of management issue.

When you installed the Down pipe it increased the flow through the exhaust system. This will effect the turbo's spooling.
The ECU has two maps for controlling boost. continuious and burst, this is known as turbo dynamics. Subaru set this up for the stock configuration. Because it is already engineered to the edge, the Waste Gate Duty cycle is at it's max value and any deviation will knock it out of balance.
This is what happens:
The exhaust pushed the turbo to boost.
The ECU looks at its map for the target boost pressure and WG Duty cycle to acheive it.
The ECU monitors the intakes manifold pressure
If the boost is too much it looks at one of the turbo dynamic maps for its correction and changed the WG Duty Cycle.
It will continue doing this until the target is hit.
Under shooting the value is not felt by you. Overshooting is!, it causes the ECU to cut boost levels and the drop is readily noticed.
Your problem is the engineered values are not compatible with the exhaust flow increase. The values in the map causes the WGS to over shoot its value. The flow is so much that the WGS is running at its max value and triggering the P0244 cel.
The best fix is to have the ECU flashed and its dynamic map corrected for you configuration. Some will say to port out the waste gate. This may work if the waste gate is ported to the exact amount that the DP increased the flow. I think this is a crap shot and very hard to do, although it can be done if the dremmel operator is trained and certified.
Your best solution is to reflash the ECU to support the changes. This is not cost effective but it just the results from you jacking with this Finely Engineered Vehicle

just wanted to add there is a trick with a FCD to get the duty cycle to stay on.
